G-325A Original Signature Needed?

Timeline

I just received my Notice Of Action 1 (receipt notice) for my I-130. Awesome!!! It only took 1 week! I want to submit my I-129F now for my wife in case the I-130 takes much longer. When I was in Honduras, she only signed 1 copy of the G-325A. I sent that with the I-130 and have copies of her signed form that I sent in.

Can I use the copy of the original G-325A with my I-129F application or do I need a new one with an original signature to submit?

Also, since mail from Honduras is slow and could take 1 month, should I give it a shot and just submit it a copy of the signed G-325A while I await a new signed one?

You'll need a new G325a appropriately filled out and with original signature for an I-129F for spouse.

Caution though, you can no longer expect to have two visa processes in tandem. The policy is to approve both petitions together and forward the I-129F and hold the I-130.

If you want an immigrant visa, don't file an I-129F for spouse.

John,

my husband sent the I 130 the same day as you did (to Chicago Lockbox) but we still haven't received our NOA1. Do you have an idea why? I am scared!

Either way, for the I130 you are supposed to send 4 pages of the G325A (signed and dated by your wife) and another 4 pages of the G325A about you (signed and dated by you). For the I129F (in case you are petitioning a K3) you also need to send 4 pages of the G325A from your wife (signed and dated by her) and another 4 pages from you (signed and dated by you). In the end, you'll need then 8 signed G325A forms for your wife and 8 for you! Oh, and they specifically tell you to send the ORIGINALS.

They need 4 pages of each document for each form. If they don't have that, they might request a RFE, saying that you need to send them further documents. Immigration might take up to 60 days to process the RFE AFTER you sent the documents in.

That means, in case you receive a RFE: after you receive the RFE you ask your wife to send the documents (one week), documents arrive (one month), send the documents in to Immigration (another week), Immigration processes your RFE (up to 60 days). That would delay your process in 2-3 months at least.

I strongly recommend you to ask your wife to send the documents to you now, and you'll get them in a month. It's better to wait one month now than 2-4 months later, right?

Don't they have FEDEX in Honduras?

I paid a little fortune with FEDEX, but at least the documents arrived in Seattle 2 days later!

John, look the I130 Instructions at the USCIS website:

Unter the topic: What Documents Do You Need to Prove Family Relationship?

D. A completed and signed Form G-325A, Biographic Information, for you and a Form G-325A for your husband or wife. Except for your name and signature you do not have to repeat on Form G-325A the information given on your Form I-130 petition.

From that, I understood that they need the originals.

If you want, check the form directly from the USCIS website and see that it has 4 pages!!!!

John, you need G-325A's with an original signature.

I would personally not already send the application with the copy, while waiting for the new signed one, because chance is big that it'll get you an RFE. Of course you have to consider for yourself how long snail mail from Honduras takes and if you want to risk sending it anyway, with the possible time loss due to RFE. But I would just get it all in order before I send it off in the first place.

Is there an alternative way to speed up the documents getting to you? Maybe your wife knows someone that will be travelling and can send it off with Fedex or UPS from there? They have worldwide overnight delivery. It costs a bit but it's fast. Just thinking out loud.

PS: you probably already know this, but please make sure that you have added all the correct things on the documents as well, like no confusing N/A and None. We mixed that up, and it's kinda frustrating to know that we might lose additional time because of this, while we can't do anything to rectify the issue in the meantime.
