Hi Guys. I was wondering if anyone knew if I would be able to travel home to Canada without having applied for I-131. I have just done my biometrics for my AOS and I am awaiting further information. I have an emergency that requires me to return home to Canada for a couple days but I did not file for the travel document. Will I be able to travel there without a problem like before, am i sol or is the application of I-131 rather fast and i would have it within the month. Any help is appreciated. :help:

If you leave without AP you will be abandoning your AOS... if it is an emergency then you can apply at your locial office by making an infopass appointment..... Take evidence of the emergency such as a fax/letter from hospital/funeral home etc.

But do not just leave.....

You can apply for emergency AP at your local USCIS office. If you leave without an AP you may not be let back in, as the interpretation is that you abandoned the AOS process.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Any country outside of the U.S. including Canada requires an AP....

Try the emergency AP... good luck

6/02/06 - Receive notice that AOS only has been transferred to California to speed things along

6/07/06 - E-mail that AOS received in California

6/13/06 - Welcome letter mailed by California... yeah baby

6/17/06 - Official welcome letter received and card will arrive within 3 weeks

6/19/06 - Card arrived in the mail.......

3/08/07 - Trip back to Peru for 10 days and our Religous Wedding

3/2007 - We're Pregnant

12/19/07 - Sebastien Joshua born 8:29am 7lbs 2oz 19.5"

3/14/08 - I-751 Removing Condition is in the mail

3/20/08 - Checked cashed

3/17/08 - I-751 Package signed and received

3/24/08 - Case moved to Vermont

4/17/08 - Biometrics completed

4/21/08 - Touched...........

6/16/08 - Touched once again........

11/3/08 - Touched again.. this is begining to feel good

They would not deny you entry into Canada, as that is your country of origin. But without an AP, it would be considered that you abandoned your AOS application. Good luck!
