Congrats! Yes, trying to pursue an IR/Cr would certainly mean an extra couple of months apart minimum. I would not have found it to be worth it. But, if you do try to cancel the I129F, make sure the I130 has made it to NVC (the NOA2 just might have the wrong language).

Before you call NVC to have your I-129F petition cancelled, I'd make very sure that you know the consequences, since abandoning the K-3 route, might likely mean that your wife will have to wait a few months extra before receiving her immigrant visa and be able to come to the US. It would avoid AOS hassle lateron but would mean you'd have to be apart longer. Is that what you want?

Good point I'll look into that. I'd choose AOS hassle over MORE WAITING any day!!! But if I can avoid AOS and still have the petitions processed in the same timeframe, I want to cancel. I need to ask NVC about this now, since USCIS has forwarded this on to them.

Cancelling the I-129F may cause you all kinds of problems and gain you absolutely nothing.

If the I-130 arrives at the Consulate, while a K3 interview appointment is scheduled but not completed, the interview appointment can be used for a CR1 visa. So, if your I-130 catches up to the K3 in time, you get the immigrant visa as fast as the K3 non-immigrant visa. This used to be best possible result for all K3 filers but few were successful. The new policy of holding the I-130 put a stop to that but it is not uniformly followed.

Again, we still don't know both your cases will get to NVC. They aren't supposed to, so they may simply have sent you an NOA2 with the wrong wording.

Congrats to First & Mrs. First!! Our I-130 & I-129F haven't been updated on their system yet either...Jim is calling USCIS right now to find out what is up. We received our NOA2's on April 3rd, you would think that would be enough time! I want them updated just to be sure that they will be moving onto the NVC...he's also gonna find out what the hold-up is on that as well. I just called NVC & they still haven't received them! Good luck on the rest of your journey!
