**UPDATE**

so i went to the clerks office and when i first got there and asked she said 'its up to the hospital' im like noooo i called them and they told me i had to ask vital statistics so thats what i am doing there. she is like you are married? i said yes. so she made a phone call explained the situation and repeated that we were married and he wasnt able to be present for the birth...but i needed to know if i could have his name on the certificate. she thanked them and hung up...and said Yes i was allowed to because we are married.

so for extra cover my butt technique i am taking the papers to the hospital tonight and going to talk to someone in the post partum area where they do all that paperwork with the new moms. soooooooooooo i am pretty hopefuly that things will work out after all. Thank God.

Thanks i am soooooooo happy too.

the lady at the hospital last night was super helpful and i feel confident she knows what she is talking about because she actually is the one that deals with all this paperwork. YAYYYYY for people that know what they are talking about finally lol

now i can enjoy the last 38 days of my pregnancy.

June 11 05-Married George, civil ceremony in New York

May 30 08-Baby Joshua was born

Jan 15-Back to NY we go...

May 10-made decision not to go back overseas.

July 10-filed for divorce

Jan 11-Divorce final

July 11-1st trip to take Josh to see George

Mar 12-2nd trip to take Josh to see George

ok so i am here in New York. George is in Saudi Arabia.

Before i left Saudi we went to the american embassy to citizen services and George filled out a general affidavit stating he is the father of the baby and wants his name on the birth certificate. it was notarized by the Consular at the embassy and Georges signature and mine are on this form.

Well here in NY apparently both parents must sign the birth certificate worksheet packet in order for the fathers name to be included on the birth certificate. problem...George isnt here and cant be here.

I called the clerks office in the county he will be born in and they said they are pretty sure that the affidavit we have will not hold up and the only way to ad his name on the birth certificate is if we went to court later.........ummmm George cant come back here.

So big problem...if his name isnt on the birth certificate....We cant file or register him for his Lebanese citizenship...and even bigger problem, George can not apply for a visa to Saudi for him. BIG PROBLEMS.

i dont know what to do.

everything ive found online suggests that if the parents are married at the time of birth the husband is recognized as the father of the child...but other things i have seen say he must be present to sign. im confused and so down hearted right now. i just wish i could get on a plane and go back now and just deliever him over there.

George is calling the lebanese consulate here in ny as well as the lebanese embassy over there. they are ding bats over here so im not putting to much hope in what they can do for us.

I am leaving it in Gods hands because if i dont, i will go crazy.

I didn't read everything posted, but I did want you to know that I didn't have the same problem you are having. I live in NY and when I had my daughter, her father wasn't there because he was hosptalized at a different hospital. He didn't sign anything and his name is on her birth certificate because he's her father. No challenged it anywhere in the process. I gave birth at Long Island Jewish Medical Center in 2002. I didn't ask anyone, I just filled out the forms and handed them in at the hospital and they issued the birth certificate with his name on it.

EAD Card production ordered: 11-12-2008 changed to 11/17/2008 Why? (I hope it doesn't change every week!)

Received AP: 11/17/2008

Received EAD: 11/22/08 (Praise God!!)

AOS RFE: 1/29/2009

AOS Approved: 3/24/2009

Called USCIS 4/1/2009 told no status change and case not yet reviewed from RFE request.

Received green card: 4/3/2009
