I appreciate all the support and well wishes. I am currently with my new baby grandson in Chicago and caring for the little angel has been the best therapy for me, Stephen and I talk several times daily.

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

It will be difficult to prove and convince the AO of EXTREME hardship. That is why I need an attorney, I have read it is not easy and to not even bother if not enough evidence exists. The extreme hardship burden of prove is the killer, it is not as simple as filling out a waiver form and submitting it.

It is also more difficult to present the case as a fiance , for married couples and with kids it is a little smoother.

The USC has to convince the AO that if the ' family member ' will not be allowed to be in the US, then extreme hardship is a direct result of it.

" Misrepresentation ", alleged or real, imagined or fact will automatically result in a lifetime ban of entering the US for the beneficiary.

I am sorry to hear the bad news. Curious about the misrepresentation being material though. The regulations stipulate that

Under INA §212(a)(6)©(i), an alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or entry into the United States or other benefit provided under the INA is excludable. The determination of materiality is a fact which would make an alien excludable or shut off a line of inquiry which may have resulted in exclusion.
. My question is how could misquoting a date of birth be material. He was either eligible for a B1 or not, Why would age be a factor?

He applied for the tourist visa with the name Steven instead of Stephen and made a mistake quoting the birth year by 3 years, he typed an 8 instead of a 5 on the application.

Age is not a factor but the alleged " misrepresentation " is automatically causing ineligibility.They think he did purposely falsify his identity on the B2 application , also

due to a lost passport I guess. But he presented the passport and birth cert. at the B2 interview

so if he intended a false identity he would have had a false birth cert. .........but he had his genuine one with the correct date. The CO said something about wanting to set " high standards " for all applicants to fill out the forms correctly.

A lifetime ban for this mistake is ridiculous. He did not commit a crime nor falsified his identity.

They are crazy. We will fight this.

The other issued I mentioned were said to not be grounds for inadmissibility but the whole picture, all of the issues together were too many, I believe the only way they could deny was to pick this " misrepresentation."

Also what I don't understand was that the chief CO said my letter was not good enough, to file the waiver , bring $545 and he would expedite it. If he won't overule it like he can then why bother to expedite it ?!

The adjudicating USCIS office for the embassy is in Accra, Ghana. These people will

make the decision to grant or not to grant the waiver.
