Question Concerning The K - 1 Visa

Hello Everyone ! My question is this . My fiancee live in the Philippines and I live in the United States . I will be visiting her on May 15 , 2008 and I wanted information about the lagality of taking the forms that she has to sign and getting those signed while I am there . I know I am not to start the process until after our meeting but we already know now that we want to be married and I would like to be a little ahead of the game , IF POSSIBLE ! Does anyone know if I can do that and if I am able to do that , what are all the documents that we can do that ? Thanks and Good luck everyone ........... Terry

Just print and fill out the G-325A forms each for petitioner and beneficiary, then just take those forms when u get back to USA. Both of you will also need passport style photos,with ur name at the back.

And a write a letter of intent to marry.And send some proof of your meeting for last 2 years.U can send them your trip to phil.etc.

Have a safe trip to Philippines and Enjoy!

I am a little confused. Have you met her before? If you haven't met her in person before then I would probably wait and have her sign the forms after your trip. You could always mail them to her. I suppose you could have proposed to her even if you haven't met but one of the clear guidelines is that you have met in person, etc. If this will be the only trip to meet her before you file it seems like you need to have a lot of email evidence/phone calls and maybe even regular mail so why don't you just mail the forms later. Maybe I am unclear on your question.....I don't really know what you are asking.

OUR STORY and TIMELINE:

07/05: Jose and I met while I was living in Costa Rica!

10/07: We filed our application (I-129F)

02/08: Petition is approved!

03/08: CR Embassy receives our file

04/08: Jose's interview in San Jose, Costa Rica (April 25th). VISA APPROVED!!!!!!!!!!!!!!!

05/08: May 14th Jose arrives in at JFK, May 16th he arrives in California!!!

07/08: Married!

08/08: AOS/EAD/AP paperwork submitted

08/08: Biometrics Appointment

12/08: Interview for Adjustment of Status, very easy and all went well!

We expect to have Jose's greencard by February!

It will make things easier if you get the I-129F and G-325A done while you're there. Also, getting your evidence together is so much easier when you're together working on it. Make sure to read well in regard to what to include. Avoid the dreaded RFE.

I had our petition in the mail 2 days after returning from China. Even so, its been an ungodly long wait. Don't make your's a day longer than necessary.

  • 07/19/07 Completed preparation of I-129F & associated documentation. Mailed it.
  • 08/03/07 Received NOA1 from the CSC.
  • 12/13/07 Received NOA2 from the CSC.
  • 01/23/08 NVC sent our case to U.S. Consulate in Guangzhou China.
  • 03/31/08 U.S. Consulate in Guangzhou China received, issued case number.
  • 04/05/08 P3 received.
  • 04/06/08 P3 sent.
  • 05/01/08 P4 received.
  • 05/12/08 Flight to China.
  • 06/23/08 Interview at U.S. Consulate in Guangzhou China- PINK.
  • 06/25/08 K1 & K2 visas received.
  • 07/09/08 We all arrive in America, Chicago POE
  • 08/06/08 Fiancee receives SSN (req. for marriage in our state)
  • 08/08/08 Married
  • 09/01/08 Moved into new house. AR-11's filed for wife & son.
  • 09/19/08 AOS / EAD package mailed.
  • 09/25/08 AOS / EAD NOAs.
  • 10/02/08 Biometrics letters.
  • 10/16/08 Biometrics taken.
  • 10/17/08 Case transferred to CSC.
  • 12/08/08 EADs approved / EAD cards issued.
  • 03/05/09 AOS approved.
  • 03/12/09 Green Cards received.
  • 09/17/10 Application for Lifting Conditions Mailed.
  • 10/04/10 NOA1
  • 10/19/10 Biometrics Taken.
  • 01/07/11 Removal of Conditions Approved
  • 02/26/12 Still Happily Married & Doing Well

The forms cannot be signed and dated before the day of your first meeting. Nobody cares where you were when they were signed. When you are together is the easiest and most efficient way to get the information on the forms.

If you've made your decision, there's no point in wasting time mailing things back and forth when you can do them in person.

Legalities???? Like some federal law that forms can only be filled out within the borders of the US??? Maybe you can't do it during a full moon either.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

There is nothing to prevent you from what you are planning to do. I too gathered blanks of the G325a and a letter of intent (on a disc) and then when we were together, (after discussions and agreement and in the final days of my visit), She filled those out with a little help from me and signed them. We took a few pictures together and when I got back I mailed the I129 a few days later. Your plan is perfectly Okay. I have actually told some people that wanted to know what to do - to do something similar if they were sure about their feelings - my fiancee and I had been talking for about 6 months before we met, so I knew we might do this. Had it not been mutual, I would have just not mentioned anything about it to her and started looking again. So, your plan to do it if it seems natural - gets two thumbs up. Good Luck

Thank You very much for your reply ! Yes , me nad my fiancee have been conversing since December 04 , 2007 and for 3 1/2 months we talked on Messenger and via telephone for 6 to 8 hours every day ! So we do know that we Love each other and want to be married . I am just trying to save time and money . Again , thanks for your reply ! ......... Terry

Hello lunabean , No , I have not met her in person yet . I will be there to meet her on May 15 , 2008 at 1:55 AM ! I ask my question only to save time and money . Have you ever been to PI?

If not hold onto to your seat cuz it gonna blow you off your feet.

Friendly Faces everywhere, despite being a 3rd world country.

Mass over population, Pollution, Sewer water going down side of road. Jeepney/ Trikes, people peeing in public.

Take it all in, and adapt to thier culture. Heck , I love it over there.

Paperwork is a hassle, seems like they have yet to discover the computer in PI. Lots of forms and paperwork done by hand, including receipts.

I wish I was going with you, Enjoy your trip.

Your question makes more sense to me now. I didn't know that you hadn't met in person yet so I figured that if you wanted to save time and get the ball rolling you could just mail the forms to her and send them in ASAP. Now I know a little more of your situation. You have gotten some good advice on this thread.....you have to wait to sign the forms until after you have met in person and then yes, you could just have her sign them while you are there so that your I-129 packet can go in the mail as soon as you get back.
