Our I-130 was approved on March 17th 2008. I received notice of action from USCIS stating that petition has been sent to NVC. When I call the Interactive voice response phone# of NVC I am not able to get the NVC case number

I-129F, we had a RFE for which we has responded and the website says "processing resumed"

In this context I would like to ask 4 questions.

1. When will I get the NVC case number for I-130 petition (how many days of waiting period?)...any statistics to guide us ?

2. Should I file a I-824 for further processing of our I-130, ( it is not indicated in our approval notice that I have to file I-824)?

3. As our I-129F has not been approved yet, is NVC withholding our I-130 processing for I-129F approval?

4. How both petitions will be processed at NVC ie., is the processing parallel and independent or one is dependant on the other?

Your answers to these questions will be of great help to us as we are anxiously waiting for our processing to be complete

1. You'll get an I-130 case number from NVC when or if they assign one. That's usually the day they receive it.

2. Approval notices don't mention I-824. Does your notice say something about your relative adjusting status in the USA?

3. USCIS may well be holding your I-130. NVC wouldn't, because they don't know you have an I-129F until they see it.

4. If both petitions go to NVC they will be processed independantly.

I'm not sure this helps you much because you just won't know about your I-130 until NVC can confirm a case number. I would talk to a person though instead of just the automated system.

Actually for those of us who had the 2 petitions approved at the same time after they fully implemented the policy of only forwarding the I129F to NVC, (say the March or April 2007 filers and on), the approval notice for the I130 does mention that you have to file an I824 for further processing. At least ours did. It said, your relative is in the US, etc. if this is not the case file an I824 for further processing.

It keep trying for that case number from NVC, you should get it. USCIS said they forwarded and since you don't have a concurrently approved I129F (still processing the RFE response), you will be in the fortunate position of which one to pursue a little further down the line.

You could try calling USCIS to see if they actually forwarded the I130, but they will tell you can can take up to 90 days for it to arrive at NVC.

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

Lately some notices have been saying the I-130 was forwarded to NVC, even when both petitions were approved the same day. I suspect some have received the wrong notice. This may be one of those cases.

I called USCIS on friday late evening and they told me that if I wanted then I could always file I-824. Thats confusing! I feel it is useless to call USCIS. I-130 approval notice did not mention about the I-824, so I am little hesitant to file the I-824.

The exact wording on the I-130 approval notice is

------------------------------------------------------------------

"the above petition has been approved. We have sent the original visa petition to the department of state national visa center(NVC) , 32 Rochester ave, portsmouth, NH 03801-2909. NVC processes all approved immigrant visa petitions that need consular action. It also determines which consular post is the appropriate consulate to complete visa processing.

The NVC will contact the person for whom you are petioning(beneficiary) concerning further immigrant visa processing steps.

If you have any questions about visa issuance. pls. contact NVC directly. However, pls allow atleast 90 days before calling the NVC if your beneficiary has not recevied correspondance from the NVC. The telephone number of the NVC is (603) 334 0700. "

That is the correct wording for a petition forwarded to NVC but you won't know for certain until NVC receives it.
