I-864 Question - Help is appreciated!

Hi fellow members,

So, I had taken quite some time to read through the appropriate threads regarding th I-864 (Affidavit of Support) form, but my question isn't really answered. Anyway, I'll try to make it clear and to the point. I have been at my job for the past 3 years or so and my salary is well over the poverty limity. My tax return for 2006 was over the 125% poverty line, but 2007's tax return missed it by $2,500 because I was in Germany visiting my husband and getting married. I have paychecks to prove that had I been there my income would have been well over the limit. Here's my question: Is my I-130 going to get denied because my tax return didn't cut it, or are they going to be able to accept the letter from my employer (and personal employee record, pay stubs, etc.) as proof enough that my income is well above the 125% poverty line. Are they understanding to the fact that I wasn't in the country, but my wages are well above the limit?

Any help/input would be appreciated! Thank you guys.

If you have at least $7500 in assets (three times the amount short of the 125% poverty line) then you meet the requirements. This could be equity you have built up in your home, mutual funds, anything that could be converted to cash within one year if you had to. Can't use your vehicle as an asset unless you have more than one in working condition. I think they scrutinize your last year most carefully but it's possible if you put in enough pay stubs and a letter from your employer that they'll approve it anyway. Just my two cents...

Thanks for the reply badspellor - Here's my other problem. I'm 23. I have 1 car (under my name), paying rent to an apartment and a college degree. I have nothing else, really. I just really hope that everything will be enough. I mean, by the time my petition even gets to the NVC, it will be around Nov/Dec and they will be able to see with my paychecks that I am well over the 125% limit.

If they don't accept it, do you have someone who would be willing to be a joint sponsor, i.e. a parent? Just something to consider if it ever comes down to it. It may never be an issue but it doesn't hurt to be prepared for the worst.

At this point, I don't think my parents are going to get involved in this one. Understandable. It was my choice and my responsibility, but you are right, it is always good to be prepared. Thanks again for the replies.

Anyone have the same situation or maybe know anything more specific that would be able to answer my question?

a joint sponsor can be anyone

I don't understand why people don't want to be sponsors

OK it is a contract that says that they are financially responsible for that person, but on the other side

your husband is gonna live with you and probably find a work and he is not gonna ask for money anybody

I did not even asked my father of he want to sign

I just told him to sign it (of course I asked him, but that was more than clear that he is gonna sign)

I needed him because I am self employed (depreciation etc.)

Thanks for your reply Elvis. That's great news that your Dad helped you out. I would love for my parents to do the same, but I seriously doubt there is anyone that would help me sponsor. So, I suppose I will have to take my chances. I just would like to see if I have the means to do it on my own. If yes, then great. If not, then I will have to wait until Feb/Mar. when I get 2008's tax return. *eyeroll* More waiting. Glee.

Anyone know for sure if what I have will be enough?

do you know what I was thinking?

Your husband being German and living in Germany

and you Being US citizen - no need for visa to live in Germany

I would just move to Germany

I lived there for 5 years

it was almost perfect country for living, no kidding i am serious

strange language , but everything else is almost perfect as the Germans are

Hey Elvis - I know what you mean. I spent many years in Germany. Fluent in the language and I love the country and the people. My husband and I are going to try it out in the USA, for me, I could care less where I live as long as I have him. He wants to try our life together in the USA and if that's something I can help him with, then why not? We both had a wonderful time in Germany and we know that works for us, but I guess you could say he is ready for a change. I am pretty sure I would need a visa to get a job there. I tried already, but because we weren't married, I would've had to apply for a visa. I do love Germany though.

I don't mean to bother anyone by replying to my own post numerous times, but I really need and would appreciate some help with this question. I have received some answers already, but anyone go through the same situation? If yes, what do you think my chances are of getting the approval.
