I am curious.. can a person from the philippines have another petitioner apply for another k-1 visa or k-3 if they went back home on the first k-1 and never got married? I was used and decieved by my ex-fiance in a very bad way.

should I report it to the uscis.?? I just dont want this person to do this to anyone else.

Wow.... i'm really sorry to hear that. There really is no guarranteed unfortunately but you have to take the risk in order to love and be loved. But once again i'm really really sorry to hear this. I will pray that God heals your heart cause He is the only one that could do so without leaving scars. Now as regards to informing the USCIS, if you are positive that she used you and only wanted to get his/her visa i would report it because you don't want him/her to do to someone else what he/she did to you. As a matter of fact you could even go further and call the embassy or consulate in the Philippines so they have a record of this also. I pray that you do well and please keep yourself contacted cause with situations like this one the best things to do is just to throw up on people or God regarding what you are going thru. Have a great day!

There is no restriction on the benneficiary... USCIS will approve the petition if they meet the requirements, the stop point is the US Embassy.

YMMV

They can certainly be petitioned for on a K-1 again, by someone else....just like you the USC can petition someone else on a K-1/K-3 if your previous relationship did not have a 'happy ending'.

Should you report? Not sure what you'd be reporting, there is nothing against the law in your situation. You petitioned for a fiancee visa, it was approved. Your then fiancee applied for a visa, which was also approved and issued. She came here....the marriage did not occur and she returned to her come country. There was nothing illegal that was committed. USCIS/DHS/ICE would or could pursue some action if there was a law that was broken, but I see none here.

You made a bad choice in this woman....now you're hurting, and that is unfortunate. As far as I know there is nothing you can do to stop this woman from coming back to the US with another K-1/K-3 or even IR/CR visa if that is what is to happen.

Hope you can put this behind you and find someone who is meant for you.

Good luck,

-P
