Fiance denied SSN!!!

my fiance tried to apply to get her SSN yesterday and was denied...her I-94 is stamped "EMPLOYMENT UNAUTHORIZED"...now they won't give her a SSN...unfortunately we forgot to take that sheet with us explaining that K-1 visa holders don't require specific permission for employment from DHS:

she tried calling today...but they told her that because of the stamp she would have to contact DHS to have it changed...good luck...how do you contact an office or department that says you have to have an appt from INFOPASS and has no phone number listed?...our closest office is Bloomington, MN & there's no phone number...

ANYONE HAVE A NUMBER TO REACH THE IMMIGRATION DEPT OF DHS??????

p.s. we are getting married April 25, 2008 and want to file for AOS right away...does the fact that she doesn't have a SSN hurt her?...

How much longer is her I-94 valid? Sometimes if the I-94 is w/in two weeks of expireation, they can and will deny you the SS card, no matter what their policy states. You'll have to wait until she gets her GC to obtain the SS card. Otherwise, I would recommend going to a different SS office, w/ the DHS policy printed out, and trying your luck again.

We filed AOS without a SSN. He did not get his SSN till after he got his GC.

Sounds like the folks at your local SSA are making the classic mistake of confusing immigration work authorization and work authorization for social security purposes. K1s by their very nature are considered work authorized for the purposes of getting a social security number; their card would come with the denotation that states further documentation is needed from DHS to establish work authorization for immigration purposes. I would go back with the article printed, and your new understanding of the rules. Demand to speak to a supervisor if you must.

BTW - it's no good calling USCIS about Social Security. They are two completely separate entites.

And as Jomo's Girl points out, you do not need an SSN to file for AOS.

You can try one more time if you go to another office. I got my SSN with my K1 visa. But yes, it had the legend VALID WITH DHS WORK AUTHORIZATION.

K-1 visa holders don't require specific permission for employment from DHS. It's not true, at least in the practice. When you arrive to JFK airport you can get an employment stamp valid for 90 days (same time that visa K1). I think there is the unique way to work immediately when you arrive USA. You can apply for an EAD with K1 visa (work authorization) but it'll valid until the visa expires.

So it's better to apply for EAD when you file AOS and you get the EAD valid for 1 year.

So, at this point I don't know for what use the SSN was before I get my EAD :blush: . Because the key is the EAD, with it you can get the SSN and next the driver license...

PD. It isn't estrictly necessary to have an SSN for file AOS. I file AOS without it (because the SSN didn't arrive at the time that we filed). I only put NONE

Some states require a SSN for a marriage license; make sure to check if MN is one of them.

nope it's not...got it already...thank god...they ask for SSN but don't need it...in MN anyway...apparently it's that way for a lot of things...driver's license, bank accounts, health insurance...so they say anyway...guess i'll be finding that out...

yup...that's what it says..."EMPLOYMENT UNAUTHORIZED"...LOL

it all depends on where you cross...i crossed in Sault Ste Marie in northern Ontario...the guy even told me i wouldn't have a problem applying for a SSN...LOL

one hand doesn't know what the other is doing...that's the government anywhere for ya...LOL

That demarkation shouldn't make one iota of difference to SSA. They shouldn't be going by that anyway - all they ought to consider is what visa you entered on.

Notice I said 'ought'. :lol:

1. When did she get here? Is it over 76 day?

2. Did they refuse to accept the application if here less than 76 days?

3. At which SSA office did this take place? City and State and address if in a city with more than one

office

Status still needs to be verified regardless, but they should take the application and run it through the verification process. Not SSA's call to say you aren't eligible as long as the document isn't within 14 days of expiring or expired.

yup...minnesota...all she saw was the stamp & she automatically said "We do not issue SSN for those who are not authorized to work"...and that she had turned away many Canadians with k-1 visas...like she deserved a badge or something...LOL...she did give me a letter saying why i was being denied in case anyone needed to know why...

i even called the office back in St. Cloud to cite what i found on their own website...and THAT lady said the same thing as the lady yesterday...i am not authorized to work due to the stamp on my I-94 and even pointed out that i am not a "citizen" and have no rights...nice huh?...basically you can't prove them wrong even with their own policy...she said that if i had a problem with their decision to call the DHS and have the I-94 changed...sure...right...okay...considering you can't even contact them...does it pay to fight it?...or will it just be me getting stressed out and running here and there and getting nowhere...i'm usually up for a fight but i'm tired of bureaucracy...LOL

oh well...i was mainly concerned that i wouldn't be able to file for AOS without it...but i'm not going to sweat it...i'll concentrate on getting married...YAY!!!!...i should still be able to do the driver's license, bank account, etc without it...
