So I forgot the RFE and I made a stupid mistake. Since I am applying through my spouse (American citizen), the sponsor (main) should be my wife. However, I was not aware of this (stupid, stupid) and only sent a sponsor form and evidence from my uncle. Now, I realize I have to send out a sponsor form from my wife. She is a law school student and does not have a job. We do have tax returns from the previous years, but she does not have any W-2s since she does not work. So, would it be ok if I just send thw tax returns without a letter of employment and W-2s. My uncle will also be a joint sponsor.

I would send the tax returns and also include a cover letter explaining that your wife is a law student and as such there are no W-2's and no current employer. Also state that a co-sponsor was provided in the initial submission

Send a copy of the complete tax returns as filed with the IRS. If the tax return did not require a W-2 then neither does the copy.

Be sure to have your wife take the course on immigration law.

Just checking.. is your uncle a USC or PR domiciled in the US?

Wifey is a USC, but my uncle is a PR. Does it make a difference? He has already sent in his form as a join sponsor, so my wife would send the spnsor form by checking the option which says that she is applying as a petitioner for the I-130. Is this correct?

BTW, I will pass on the suggestion about the Imm. law class...

Anyone know how long this will set me back? I guess the good thing is that they are looking at my application...

An LPR can be a joint sponsor. Does have to be domiciled in the USA though
