Timeline

Do you have to do it ASAP or can you wait awhile.This may sound dumb,but I really don't know. :blush:

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE

You have to get married within 90 days

there is no time limit for when you file AOS by though!!!

The previous poster is wrong

all you need to file after the marriage is the certified copy of the marriage

I agree this is not correct.

You have to get married within 90 days.

I filed mine about 5 weeks after we got married (had to get marrige certificate and such).

Was no problem at all and I just got approved today.

It is however best to apply as soon as possible,or else you will be out of status like I was,was just a pain in the butt cos I was not allowed to work and that.

That's incorrect.

However, some say as soon as you get married you are 'technically' out of status and others say when your I-94 expires is when you are out of status.

12/24/2021 - Motion to terminate deportation proceedings from 2013 filed

You'll need to file more than just a marriage certificate!!!

See the guide for AOS and download the relevant forms from the USCIS website.

You should ideally file for AOS before the expiry date on your I94 but people have filed after that date with no problems.

Having your paperwork filed promptly will keep you within "official" status and will mean that, once you have Advance Parole and Employment Authorisation documentation you can travel outside the US and be legally able to work sooner.

I would do it sooner rather than later.

If you wish to work or travel, the sooner you file, the better. It takes up to 90 days after filing to get authorization to do either.

I meant that the only thing that you need from the "marriage" to file is the Certificate!

It's obvious that you need more than just the piece of paper to file!

It's obvious that you need more than just the piece of paper to file!

What? You mean you can't just mail a marriage certificate in to USCIS and be done with it? Surely there aren't any more fees or interviews. Perish the thought. :lol:

You can file as soon as you have a certified copy of the marriage certificate in hand, or you can wait until you are otherwise ready. Most folks want to get on with it as soon as it is practical for them to do so.
