Just wondering, what mailing address did you all use on the W-7. Was it yours in US or spouse's foreign address?

US address

Please confirm:

I filed MFJ and applied for an ITIN # for my husband. I am being taxed on his foreign wages, so why wouldn't he be able to get the rebate?

Also, just to clarify....

I hope he will be here soon. Hopefully, by the summer. Once he gets here and gets his SS#, we can amend our 2007 tax return...or what?

how do we get the rebate?

You'll get the rebate next year when you file 2008 year taxes. There is no question "why", it is IRS law.

Per the Stimulus guidelines you are not eligible to for the rebate. You would've had to file married filinf seperately. Then you would not have needed to include your husbands foreign wages and at least YOU would've gotten the rebate. I don't think you can ammend the taxes to married filing seperately and get the rebate either. Once you file and are not qualified for rebate the rebate passes you by. meaning you cannot get the 2007 rebate when you file 2008 taxes.

You can not ammend a joint return to seperate returns. Only seperate returns can be ammended to joint. States so on form 1040X.

IRS has said that 2008 returns will probably include a line asking if you did not get the stimulus payment in 2007 but are now qualified for it (spouse got a SSN before filling 2008 taxes) and you will get your $1200 credited to your 2008 return.

I put mine.... the tax guy said to do that even though it reads as if its the other way around.

I guess, my stuff iss bass akwards, I got the money, but no ITN officially yet.

obviously they couldn't deal me the extra cash out had they not ITN'd it.

Weird....

now my state return money has been zapped to my account....

I wonder if this means there is some automated communication between the ITN issuing dept. and the state.

I still haven't got an official ITN in the mail.

BUt I've got my moneys. [but still no NOA2]

my state is being held until he gets a number, but i do know of one case, the person got the state return and federal having problems with the number for them. So i dont understand why or how they would go ahead and process some without the number and hold others waiting for the numbers.

Since my tax return money landed in my bank account this week, I assume they finally assigned my wife her ITN (i had sent in all that stuff needed to get it with my paper return).

I haven't got anything in the snail mail yet, and I need the ITN to finish off my state taxes (which are on hold awaiting this number also)... (way it works is I have to mail it in)....

can I get this from IRS? or is it on it's way in the mail? (if anyone's got theirs would like to hear about it).

will be nice to open a joint savings account also.

When did you fle your W7? I filed 8 weeks ago and still nothing. I called yesterday and they told me 10 weeks to issue ITIN and then 8 weeks for refund. That puts my refund arrival in June!
