What was the error?

I dont want to say in case BB is monitoring.

My question is the I-129F for just getting my fiance in country and then the AOS is

dependent on data that we have amassed since then?

We are legally married and stay out of trouble.

I am a US citizen with NO criminal anything.

It will all depend if it was an 'error' or a 'lie'. Even if someone has their 10 year Green Card and it comes to light that they lied to enter the country in the first place they can have their status removed from them and they will have to leave the country. It's called 'misrepresentation' and USCIS take a very dim view of it.

And like John and Marlene just asked - it will also depend if the K1 could have been denied if the error had been fixed.

It was simply an oversight.

Somenthing I forgot to list that happened 13 years ago.

Now it's all going to depend on what you forgot to list. If you won't tell us then no-one can really answer your question. If it was a criminal offence it can certainly have an effect on AOS.

Not a criminal offense. It was something I forgot about.

I brought a lady over on a K-1 ,13 years ago.

She left within 90 days and never heard from her again.

She never made any problems. We didnt get married, etc.

Wouldnt they of caught that before now?

I have been told since then , that they clock starts over every 10 years.

It was my mistake and not hers.

I dont see how it would matter anyway, b/c we are allowed 2 K-1's every 10 years.

And 13 years ago I believe it was 5 K-1's.

What should I do now?

Have you had an RFE asking for this information? How has it all come to light now?

If you have had an RFE you need to send them whatever they are asking for and hope for the best. The previous K1 might not be a problem in itself but not mentioning it originally may well be.

The petition has been adjudicated...

I doubt it will be re-opened and besides... you are allowed two petitions (not within two years) without a waiver request and additional petitions with a waiver.
