Hi guys,

Here's the situation; Got conditional GC expiring 8/2009. Marriage failed, divorce filed, waiting for the decree. Planning to remove conditions on waiver when the decree becomes available maybe a month or two from now.

After an awful divorce I am dying to go home to visit family this Sept and already bought a round trip ticket.

My question; Given I filed removal of conditions with waiver this June or July and go home for a family visit this Sept, is there any problem going back in the US? I am worried immigration might question my CGC while removal of conditions on process?

Please I need your help and advice. Thanks a lot!

Your GC will expire on 8/2009? You can only apply for unconditional GC within 90 days before your current GC expire next year.

AFAIK U can apply once the divorce is final.

Correct.

For waiver issues:

1. if it's due to divorce the person can apply once the divorce decree is in hand, you don't have to wait for the 90 days prior to your expiration date.

2. in case of domestic violence the person does not need to be divorce and can apply at whatever moment.

Once you get your decree you can apply for the removal of conditions and attached all the relevant information and evidence.

For travel issues:

You must apply and get the extension letter NOA1 of your status before traveling and your expired green card. You should not have any problem. It is normal that you would be in a situation of need of traveling once your case is pending, is taking a lot of time, especially in VSC. Many of us traveled with our already expired green card/extension letter/ or stamp.

You will recevied a letter for biometrics -NOA2, same as the first round with the i-485.

I appreciate the response. With my situation as I stated on my original post, when I filed the removal of conditions with waiver even though my CGC expires 8/2009, will they still give me extension letter like everyone got?

I am thinking to be safe in getting back here in the US w/o problem, having the extension letter plus my CGC expiring 8/2009 will be best, isn't it?

If I file the removal of conditions this June, will I'll be able to receive the extension before Sept of this year?
