My daughter will be having my first grandchild this year, and this has changed our decision on where to live.

We have been married for almost 8 years and have been living in Jamaica. Our thoughts are to go to the US (where I am a citizen) and file for him (Jamaican national). I have noticed most of the cases are newly marrieds (congratulations to all) and have the following questions if anyone knows any answers.

Do you still have to provide proof of relationship if you have been living together outside US?

Since we travel frequently to the US, can we file in the US on one of our trips?

Is it necessary for both to be at the interviews?

You could file while in the USA, but he'd still have to await the proper visa, and be prepared for consular processing in his home country.

I have been married for more than 6 yrs, The embasssy didn't ask me to provide proof of relationship ( only married certificate, They looked at both passport in which has UAE resident visa - soo they know that we are living together ).

Since we travel frequently to the US, can we file in the US on one of our trips? Someone else can answer this one.

Is it necessary for both to be at the interviews? Yes, both of you should to be at the interview

I think your best bet is to file directly with the Consulate in Jamaica while you are living there. Whether both CAN attend the visa interview varies by Consulate but for a visa, only the visa applicant is required to attend a visa interview.

If you've been married for six years, you won't have any problem showing a lease or joint bank account. Almost anything will do when you've been married that long.

Check directly with the Consulate as to whether you qualify to file directly with them.

Thanks for the answers. We are still debating the issue pros and cons. Neither of us have had any plans to live in the US before this grandchild thing happened:). At least we have time to check and see our best option.

Has anyone worked outside the country, then tried to get their spouse a visa? Curious if you have to work long enough for a tax return before you can get them over..

Can my daughter bring him over?

You are required to file tax returns, even if your foreign income is exempt from tax. You'll need at least one for the visa interview. Since your income is unlikely to continue from the same source, your daughter can serve as a joint sponsor. You are still the petitioner for your husband. Your daughter can't petition her step-father but she can be joint sponsor.

This is not a simple straight forward process but those who learn it with diligent study can usually be very successful with it without an attorney. One key is to study the guides and read about the experience of other in numerous threads. If you only ask questions, you'll miss a lot of important information.
