sorry - new topic on the same issue as apparently the last one I started on this was moved but not sure where to?

Can anyway direct me to official website info on what is needed for someone to sponsor me for a K1 visa? I want to see something on how to work out whether it should be my finace or his dad who complete the afidaviate of support.

There is very little information on official sites re sponsorship requirements for the I-134 when it is submitted for K visas as it is not an official requirement for K visas even though it is used by many consulates to help overcome the public charge issue. The only place I have seen anything of any significance is in the FAM.....see here http://foia.state.gov/masterdocs/09fam/0940041N.pdf You will need to scroll down about half way for info on the I-134. Hopefully you can pull some relevant info from it.

Aussiewench gives you a good reference. Read carefully and be sure to distinguish between the information that applies to immigrant visas and the information that applies to non-immigrant visas including the K visas.

Your closing statement indicates that your fiance does not qualify to sponsor you and so his father will be your sponsor? So clearly the father will need to provide financial documentation. Whether or not your fiance will be asked to supply financial documentatin also is a good question that probably you won't get a definitive answer to until you are at the interview. There is little anecdotal evidence on the issue.

You might want to try a little experiment that a few others have tried at my suggestion - certainly be prepared with a full financial package from your fiance in case it is asked for by the interviewing officer, but initially submit only the financial package from his father. See what happens, and let us know.

Me again... so how does this afidaviat thing work.... could we try submitting it for my fiance first. If they deem it is not enough when do they let us know... will it be an RFE asking for someone else to be my sponsor? Or do they turn down your whole application cause that part is not right?

How can they RFE you at the embassy? The I 134 is not looked at until the interview. So there is no way you can 'submit' your fiance's first and see what happens.

If you feel your fiance's finances will not be sufficient, then secure all the necessary forms and paperwork from your future father in law and take it to the interview.

I suggest you read the K1 guide and familiarize yourself with each step in the process before you find yourself in a bind you can't work your way out of.

Agreed, it's not appropriate to use the term 'RFE' in the context of the visa application to the consulate.

But it should be possible to hand in only the fiance's financial package with the other forms and documents on the day of the interview. (Or in advance, if that's how it's done in London.) Then during the interview, if the interviewer says something like 'you're all set except that your fiance is not an adequate sponsor', respond 'How about his father?' and slip the father-in-law's package under the window?

I agree, Y. However, I was trying to make sure globetrotter didn't just arrive with her fiance's I 134 in hand, hoping it would be enough and if not, have nothing else in her hand to present.
