I filed the I-130 package on October 26th, 2007. It was received by VSC on October 29th. It has been almost 6 months, it is now 4-14-08 and no NOA1 received as of yet. No communicastions received period!

I called them several times but I am always told that my case is not in the system and that the EAC number that I have is valid but it doesn't bring anything up. How can this be? They cashed the check assigened a case number but are unable to find it? Frustrating.

I opened a case with USCIS on 2-27-2008 about a missing NOA1. Received an email on 4-10-2008 that stated: "Based upon the information you provided, the Vermont Service Center is not able to locate a record of your filing at this office." Fortunately I do have a copy of cashed check with a case number. I will be sending a copy of that to VSC on 4-14-08. I also decided to switch my process from K3 to IR-1/CR-1.

Could they really lose my case eventhough the check was cashed? Anyone had a simmilar experience?

They lost my I-129F and they asked for some documents (I think they asked for copies of entire package-luckily my husband kept them) and they found it after that.Since we didn't receive NOA1 after a month we decided to call them and they said that they had lost it.It's so common For VSC to lose applications, I really don't know why.Hopefully they will find yours soon.Good luck!!!

Assume it is lost -- send a new I-130 in with a copy of both sides of your cancelled check and maybe/hopefully they will do the right thing and put you in the proper order and also send you a proper NOA1.

If you wait for them to tell you it is lost you may lose time. Right now at 6 months you're likely to be processed soon (if they didn't lose it which seems like they did) so you'll want to step on this.

Put in a cover letter explaining the situation.

First of all, let me say I feel your pain. :crying:

We sent in our first K1 application last May (2006), and waited until nearly November before discovering that they had lost our application. Despite the fact that we have the receipt that it was received. My fiance finally got on the phone, and was able to speak to someone to confirm that it had been lost, and advised us as to our next course of action. So, with a special 'letter of permission' that said we could have two applications in process at once (just in case they found the first one), we resubmitted our entire application in December, have now dealt with and returned two RFE's, and are currently hoping for the NOA2 any day.

For what it's worth, with the second application we got a phone call that everything had been received and checked in, and then they lost my fiance's birth certificate. So he had to go and get a THIRD COPY of his birth certificate and send that up to VSC, as they said they could not process the case without that one critical document.

I would call sooner rather than later and see if you can get someone who can help you track things down - if only to know where you stand and what your next course of action needs to be.

MS7 is right. Assume it got lost because its been 6 mos. Make a new application and attached all the documents needed together with the copy of the check that they already cash. Let them know what happen and at least used express to track the mail that your sending.... Good Luck.

I'm not sure if this is the best idea, but worth a shot. Did you do an info-pass? Maybe if they saw your cancelled check, they could do more searching on the number that the person over the phone can't find. I know the folks on the phone are real quick to get you off the line, so that's why I mention this.

What did they suggest you do, given that USCIS has cashed the check?

oh, this completely SUCKS!! :angry:

Is there a way for you all to get an expedite since it was USCIS' fault that the application was lost. Please contact your congressman and show them all the documentation that you have from USCIS that they said they lost your application. Ask for an expedite since you have already been waiting well over 6months.
