Hello everyone,

I've seen in other posts that members had sent an e-mail to the CSC and in doing so had their cases touched. Well, while I certainly do wish to be touched that is not my reason for asking for the e-mail address. I don't know why, but I just haven't been able to find an e-mail address for either the CSC or the NCSC. Maybe it is because I need some sleep.

In any case, I wish to ask them (and I've asked this question before here in the K1 forum) if after our petition (God willing) is approved and my fiancee's interview results in approval, her Visa in hand, can we marry there in the Philippines before I accompany her back home to the U.S.A.? When I posed this question some time ago I received replies such as this (and I'm paraphrasing) :

"You might try marrying on Friday, flying back home on Saturday and hope it doesn't catch up to you later."

"Have an unofficial ceremony there in the Philippines and make it official once you are back in the U.S."

"It may be considered immigration fraud, as the spouse would be entering into the U.S. under a Fiancee Visa."

Yet, I swear I remember talking to a friend of mine who brought her husband over here to the U.S. (they were married overseas) and she told me that many will apply for which ever petition(s) (K1/K3 or both) are moving the fastest at the time. Anyone?

The reason I ask this is because many of my Fiancee's family of course would like to witness our marriage ceremony and my Fiancee feels that an unofficial ceremony would not be liked or accepted by her family members.

The K-1 visa is a fiance visa. If you marry officially either after or prior to the interview it negates the petition/visa. If you are wishing to marry then you would need to start again with the K-3 visa. It really doesn't get much simpler then that. A K-1 holder is entering the US as a fiance of a USC and marries within 90 days. If it is uncovered that an official marriage has already taken place prior to entry then it wont be taken lightly and could delay your being together.

Your fiancee has to be single when she arrives in the US otherwise she will be violating her fiance visa terms. Getting married here while she's on K1 would constitute FRAUD resulting to consequences you may not even want to think about.

Unlike Thailand, the Philippines do not have "unofficial ceremonial wedding". Maybe you can ask for a priest's blessing but I'm sure that would be unacceptable to her parents/relatives.

Suggestions:

1) Have a civil wedding in the US then come back to the Philppines for the traditional wedding after your fiance gets her AP.

2) Abandon K1, get married in the Philippines then apply K3. Which means, you have to start all over again.

Hi PatientlyWaiting,

I certainly don't want to mess things up by committing Visa Fraud. God, I couldn't stand it if she were banned from entering the U.S. for up to 10 years.

I think we will have to follow your 1st suggestion and return to the Philippines later to be married in front of her family. I like the idea of receiving a blessing from a priest while I'm there to accompany her home to the U.S.

Their answer, if they answer, will be 'No'.

But in any case, the USCIS is not the best place to ask such a question. For one thing the people who you may be able to get in contact with at the CSC most likely do not know the law, they know USCIS policy and procedure. For another, the CSC is processing your I-129f, and having expressed a concern about this issue you may get yourself an RFE for evidence that you and your fiancee are not already married.

If you have a questin about law ask an attorney, not the USCIS.
