Hello,

Let me briefly share my story first. I'm here in Ecuador with my wife, she and I just got married on 3/24/2006 in Quito. i'm here with her on a tourist visa, but we're living in an apartment together until we get the papers to go to the US. We were approved for the 130 on April 27th, last thursday. My questions are regarding the affidavit of support. Here goes:

1. If I choose to put my "domicile" as my mom's house (the address listed on my tax refund) and all my current mail credit card statements, bank statements, etc. would that suffice as keeping "ties to the US?"

2. Will this domicile also suffice even if we don't plan to stay there for a long time? We really only intend to stay there for maybe 2 weeks max as we find an apartment for ourselves.

3. Since I am unemployed in the US currently, because of being in Ecuador, what do I do about a job letter? I plan on returning to the same job I had, and my boss is waiting my return, would a letter from her stating that I am welcome back anytime be OK?

4. Do I need to show that I meet the poverty guidelines for not only my wife and me, but also my mom?

5. My Dad is going to co sponsor my wife, but he does not live with my mom (where we put we are going to live.) Does that make a difference?

Thanks for all your help. I'm really trying to see if I need to go back to the US and start working before we turn in our paperwork for the final interview. Thanks again!!

Removal of Conditions:

7/1/08 - Removal of Conditions Window opens

7/21/08 - Sent paperwork off to CSC

7/23/08 - Paperwork arrived to CSC per Delivery Confirmation

7/28/08 - NOA received, postmarked 7/25/08. $545 Check cashed today also.

8/6/08 - Biometrics Letter received with an appointment date of 8/22/08

8/22/08 - Biometrics appointment completed

8/25/08 - Case status available online

11/11/08 - Approved!! Received GC in the mail today. They didn't change her last name like we asked, but I could care less right now.

The more ties you can show the better as far as domicile goes. A letter from your prior employer with a job offer on your return would help. Have a read here for more info on domicile http://travel.state.gov/visa/immigrants/info/info_1328.html#4

1. As you describe your situation it sounds as though your mother's house is in fact your US domicile. (Where are you registered to vote?) Recognize that this has implications for your I-864 - your mother is a Household Member.

2. You're free to move any time you wish, any where you wish (unless there's something like a court order resticting your movement).

3. It would possibly be better if you were on a leave of absence from your position rather than free to return to it (although in either case the employer could decide at any time that there's nothing for you to return to).

The more positively the letter is worded the better it will be for you.

5. A difference as to what? It makes no difference as to your I-864.

You might not be able to find that out before you turn in your paperwork.

I was at the Consulate on other business before our interview and took my I-864 in for review ahead of time. I had an unusual situation and wanted to know if I'd put everything in the right boxes and if it looked 'approvable'. The staffers were good enough to take it back to the fellow who reviews I-864s and he looked it over and gave me a tentative 'OK'.

#5: review the I-864 for how Joint Sponsors complete that doc. Your Joint Sponsor does not have to live with you (and your mom would have nothing to do with that).
