I filed I-130 for both my wife and our son on December 12th 2007, yesterday my son's I-130 got approved at CSC, however there is no word on my wife's I-129F nor on her I-130. I am not sure what to do at this point. Since my 3 year old son's I-130 has been approved, and according to the letter, sent to NVC - can he still qualify for K4 visa? Should I use RFE line and talk to somebody at CSC? Should I go ahead proceed with 1-130 route through NVC just on his case, or ignore the correspondence from NVC and wait for one of the other peitions to get approved?

something slightly similar happen to me with their noa's i received Alexci's noa1 first and then about a week later Ekaterina's even though they had the same received and issued date on them. I would wait until monday and call. and congratulations!!!!! they are at least touching your file!!!

For the time being, I would just wait. If you want K3 and K4, I wouldn't pay unnecessary fees to NVC or let your three year old's process get ahead of your wife's.

I suspect all the petitions will be approved shortly.

For the time being, I would just wait. If you want K3 and K4, I wouldn't pay unnecessary fees to NVC or let your three year old's process get ahead of your wife's.

I suspect all the petitions will be approved shortly.

Well, now that I had some time to sleep on in it and get over the excitement of being approved I'll tell the story. After my son's I-130 petition got approved, I called USCIS (using RFE trick), talked to a nice lady, who said that my wife's petitions were in Division 5 and they were not even assigned an office. I told her that I did not think that my wife would ever allow a three year old to fly by himself, nor that I could handle him on my own :) She laughed and said that she would send an email. As far as NVC goes, she said that they would have no problem holding his petition until she is approved. I got a touch later that day (april 14), I called on the 16th and was told by another officer that our petitions were assigned to an officer now and that approval could happen any day. We got touched ont he 17th and were sure that we got approved, however there was no change on the website. I called on monday (21st) and spoke with a male immigration officer who said that we should get approved either today or tomorrow. We got touched on the 22nd with no change on the website and then on the 23rd got emails that our case was approved on the 22nd. I am not for sure what to do with my son's I-130 which is pending at NVC. I do not know if my wife's I-130 will be forwarded to NVC either. I read somewhere that my son could get a certification of citizenship upon arrival to the US, does it mean that he will not need his I-130 and K4 visa would be enough for this. Any input would be welcome.

If you are the biological father, you can simply follow the procedure to get your son a US passport at the Consulate abroad. He never needed a visa. If, step-son he needs a visa and will have citizenship requirements similar to that of your wife. Similar in that he takes a minimum of two years longer.

If you are the biological father, you can simply follow the procedure to get your son a US passport at the Consulate abroad. He never needed a visa. If, step-son he needs a visa and will have citizenship requirements similar to that of your wife. Similar in that he takes a minimum of two years longer.

If you want them to arrive with K3 and K4 visas, just ignore the I-130s.

I am the biological father of the child, however, he was born before I obtained my citizenship. He is 3 years old, not sure how citizenship is obtained at that age.

I thought children under 21 go through a different route than adults as soon as they get an immigrant visa.

Certain children born out of wedlock to a mother who naturalizes, and

Adopted children meeting the two-year custody requirement.

1) Does my child qualify for automatic citizenship under the CCA?

Under CCA, your child will automatically acquire U.S. citizenship on the date that all of the following requirements are satisfied:

*At least one adoptive parent is a U.S. citizen,

*The child is under 18 years of age,

*If the child is adopted, a full and final adoption of the child, and

*The child is admitted to the United States as an immigrant

It's been a WHOLE day. Give it time. Let the person who is working on your wife's case get a chance to update her file. Even though you filed both cases at the same time, each are its own case so don't bunch them together. I always got information about my son's and my case sent to me within several days apart. I wouldn't worry. Patience.
