MY HUSBAND FILED FOR A DIVORCE JAN 12 07 AND THAT TIME WAS MY WINDOW TO FILE FOR MY I 751 ,SINCE WE ARE STILL MARRIED WE BOTH DECIDED TO FILE JOINTLY & HOPING THAT HE WILL CHANGE HIS MIND & TRY TO WORK THINGS OUT,UNFORTUNATELY NO ATTEMPTS OR RECONCILIATION HAPPENED ... CURRENTLY WE HAVE BEEN LIVING SEPARATELY SINCE WE FILED FOR MY I 751 WHICH WAS FEB 6 2007 AND THEN I HAD MY BIOMETRICS DONE MARCH 10 2007.. THE LAST TIME I CHECK NEBRASKA PROCESSING TIME WAS FEB 9 2007 AND MINE WAS FEB 6,,I THOUGHT I SHOULD RECEIVE ANY INTERVIEW OR A LETTER BUT UNTIL NOW IT IS STILL PENDING & WAS TRANSFERED ALTHOUGH I ALREADY HAVE MY I 551 STAMP ON MY PASSPORT... MY HUSBAND CAN NO LONGER WAIT FOR ANOTHER 6MONTH OR 1 YR AND WE WILL HAVE A DIVORCE HEARING NEXT WEEK,I DONT KNOW IF I SHOULD JUST SIGN THE DIVORCE PAPER AND WITHDRAW MY OLD FILE AND SUBMIT A NEW ONE WITH THE WAIVER ONCE MY DIVORCE IS FINAL? HOW DOES IT WORK? WHAT ARE THE STEPS? REGARDING ABOUT THE WAIVER BOTH MY MOTHER IN LAW & FATHER IN LAW GIVE ME A AN AFFIDAVIT OF SUPPORT THAT I ENTER IN GOOD FAITH IN MARRIAGE , I HAVE ALL THE PROOF OF ALMOST 6 YEARS OF MARRIAGE & IT WAS BONA FIDE . ANY PAST EXPERIENCE ,ADVICE & COMMENT IS GREATLY APPRECIATED...

JUAN01 is sooo right. I am new to this site, but went through old posts (and learned a lot-so many dif situations). Check old posts-great deal of info and responses to situation similar to yours.

Couple of posts about denial of I-751 when divorce was ONLY filed (no hearings-so they might be checking court records).

From this forum I have learned that if your divorce comes before I-751 approval-you cannot really apply for ctzship (otherwise, your 10y GC gets revoked).

If divorce is imminent-new I-751 a must (with waiver).

I just hope it helps. But I have learned it just now from this forum-no real experience (my lawer did all my papers and I just became curious what the procedures are). Take time scroll back posts-you will find many people in similar situation.
