A friend of mine wants to know the details of both the K Visas, K1 and K3.

His girlfriend is in Mexico currently, she has came to the U.S. on a visitors Visa. He misses her terribly and wants to go to mexico NOW and marry her immediately and he wants her back home in the U.S. with him.

Whats the best visa for him, which one is quicker? Any advice you can give to help this couple out?

Marriage in Mexico then K-3 or CR-1

Marriage in USA then K-1

i know that information...that is not what i asked......

Sure it is... you said "he wants to go to mexico NOW and marry her" ... if so then K-1 is out and he needs K-3.

just pure logistics says K-1 is faster because you can file TODAY rather than wait to go to mexico TOMMORROW to get married and then file on teh day AFTER tommorrow.

Not all are the same. In some cases K1 is quicker than K3 , and in some cases K3 is quicker than K1. Depends on the case of the filers.

But if you have enough evidence already in your relationship in filing for K1, then why not file k1 now so you can start your waits already, rather than go to Mexico and get married there and you will still need to wait for your wife to get your marriage certificate before you can start filing the IR-130 then wait for the NOA1 from IR-130 before you can file the 129-F (which is the K3)

If he wants to marry her in Mexico and bring her back, then he would apply for a k-3 visa.

If they apply for a k-1, they will have to wait until she receives it to get married once she comes to the US.

Both involve waiting to be together. With the k-3, they can get married now but have to wait until she can come to the US permanently. With a k-1, they CAN'T get married now.

IMO, it depends on what is important for the couple and what they want. Where do they want to marry? Will they rather be separated while waiting to get married? Or want to be separated after getting married? It depends on each case.

In our case, our decision was based on the fact that we did not want to be separated after getting married, so we chose K-1.

APPLIED FOR NATURALIZATION 07/2021

08.01.2011 - I-751 SENT

08.05.2011 - Check cashed

08.08.2011- NOA Received

08.19.2011 - Biometrics Letter Received

09.12.2011 - Biometrics Appointment

01.27.2012 - Card production ordered

02.01.2012 - 10 year GC Received

07.25.2021 - N400 filed online

08.09.2021- Biometrics re-use notice

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

05.19.2022- Oath Ceremony in MN

There's no simple answer, because the length of time it takes depends on country, embassy, individual case details, how competent USCIS is at that particular moment in time, luck, etc.

Most of the time it seems to me that the I-129F petition for K-1 is processed a month or two faster that I-130 and I-129F for K-3 visa. But this is only the first step in the process. In some countries/embassies/consulates/etc. there is a much longer wait for a K-3 interview than for K-1 interview so you have to try to find out that information for yourself.

In general, it was my opinion that the K-1 visa was a month or two shorter than K-3.

03/19/07: Initial mailing of I-129F.

07/07/11: U.S. Citizenship approved and Oath Ceremony!

MIL's visa journey:

07/26/11: Initial mailing of I-130.

05/22/12: Interview passed!
