:angry: My husband and I must be cursed with the USCIS or something. They just don't like us. :blush: We received an RFE and I'm kinda confused as to what information is missing :unsure: . I submitted my tax transcripts for 2002 and 2003 and a copy of my complete return for 2004. I also included recent pay stubs as proof of employment and my w-2 for 2004 and 2005. At the time we filed AOS, i had not yet filed my 2005 taxes so I included my return for the most recent tax year (2004) as it said you could in the instructions. The RFE said that we did not provide sufficient evidence to prove that we meet the 125% poverty guidelines. As a K-1'er our having met that requirement is inherant or my husband wouldn't even be here. I guess this is more of a vent than an inquiry. I'm just going to send them my complete 2005 return in addition to everything I already sent...I make WELL over the requirement...I just think they want to give my husband and I a hard time...

for the life of me I cannot figure out why they seem to get "stuck" on certain pple and begind to dig, I know it seems like they got nothing better do to but it is nerv racking. Hang in there HUGS!!!

No, it isn't.

And even if it was, the section of the INA that contains the financial requirements and documentation for immigration does not include a section that excuses K-visa people from the documentary requirements.

Ya just hang in there. Hopefully it will turn out alright. Sometimes they lose things and then they send stuff like that. I also got an RFE on our AOS, not for our affidavit but for other reasons and it was stuff we sent in with our application yet they sent us and RFE stating they hadn't recieved that stuff. Hopefully it won't be nothing big for you.

Please explain. It was required for his K-1 petition that we meet that requirement, so I figured it was already a given that I made at or more than the 125% no??? :unsure:

Also, I am not looking to be excused, I supplied all of the necessary documentation. I just figured they would already know that i met the requirement as we just completed the K-1 process less than 90 days prior....

Sucks big time!

Yeah looks like we're in the same boat. I'm just going to photocopy my 2005 tax return and submit that. Also, I just started a new job this week. I'm making about 15K more at this new place, u think I can submit my offer letter as new proof or should I get my new job to write me an employment letter?
