Got an RFE for the full medical last week. I've emailed my congressman to ask for assistance after reading a couple of threads with similar situations. I'm wondering if it wouldn't be better to just do the medical to avoid delaying AOS. Any suggestions would be appreciated.

When I read the other threads, someone mentioned that they got the same RFE and did the medical over, then got an intent to deny letter because TB testing had not been done. I asked my hubby and it seems that he didn't get a TB test, either. I'm only assuming because he said they only stuck him to draw blood. Unless there's another type of TB test, he didn't have one. And we have his X-ray, so they don't have that.

Isn't TB testing required in the medical for the K1? If so, are the panel doctors not doing all of the tests that are required?

Just starting the journey, haven't yet filed... Until today(2/12/07)!

We also got RFE'd for a medical. We turned in the medical from my wife's k3 but they wanted the stateside one with a civil surgeon. I read some people had the medical from their visa's accepted and some don't, I think it's a 50/50 chance. If they RFE you I'd just get the whole medical redone. It's really not worth a couple hundred bucks and a lengthy battle to get them to accept the original one. And yes, they redo the TB test, my wife got the one where they stick the needle just under the surface of the skin and see if it swells over a couple days, she had the same done before we left Taiwan a couple months before.

Before I'd go and have a complete medical redone, I'd be calling the Dr's office in the beneficiaries country and asking to resend a copy of the complete medical they did before the beneficiary came here. It's possible that they have a copy of the medical and can send it to you, and you can just send that back to USCIS.

I had the chest x-ray done, no TB skin test at all. The chest x-ray was used to determine whether I needed a skin test I'm thinking. If the x-ray is clear, I have no idea why they'd want to do a skin test. There was something going around when that American guy got aboard an international flight with TB, that people were required to have a TB skin test, but my understanding is that this was a regional practice to ask for that at the AOS stage, and that it wasn't a requirement of USCIS.

Alot of countries just do the chest xray for the TB test without a skin test being done. (Personally I think it is better cause of what it shows and for those who have had the shot give false positives.) however, last year came the idiot from here in the US who flew all over the place in several countries with a particular active form of TB and now some of the offices are requesting the skin test, even if the xray was done and cleared.

I hate to say this, but I would get the medical redone. I also had a medical in the UK, I didn't have a TB skin test but did have a chest xray. I was told that my original medical got lost. I contacted my congressman who really couldn't do anything as time was running out before my aos was going to be denied. The medical cost me another $220 I am pregnant so didn't have an xray but my TB test came back clear. My case is being held in CSC the last touch I had was 19th march and I still haven't heard anything. I applied for my aos in July so it looks like if you hold off in getting your medical then it could hold up your case.

On principle I did not want to redo the medical, but on a practical level I did because of the desire for completion.

YMMV

fwaguy, that's exactly where I am. I'm resisting getting it redone, but in the end I don't want to delay AOS so we may just fork over the dough.

I got the same RFE and Did Not redo the medical, simply on principle that I'd already had it done and it was their own damn fault that they'd lost it :P

I got the doctor in Toronto to send me a copy (cost $40) of the medical I'd had done up there and sent that to USCIS. Our Senator's office had already determined with USCIS that they'd "misplaced" my file, and as they know their own rules (one would think) I shouldn't have to redo the medical at my own expense (and in my area the civil surgeons charge about $400 for the exam!).

They got my reply and then scheduled me for my interview not long after and I passed no problem.

YMMV.

And hey, you and I have the same Senators! Which did you contact?

At the time it was John Edwards and Elizabeth Dole. Only Dole's office returned any of our calls (we had to use their liason services for all 3 steps during the process). Edwards' office never bothered to help anybody who wasn't a registered Democrat :P And we weren't the only couple at the time having problems with immigration.

Dole's office was great, every time we needed them.

No idea if the current Dem would be helpful at all, we haven't needed them.

  • 4 weeks later...

Well, I contacted Senator Dole's office. The woman there was very friendly, she said she would contact USCIS by email to see if the RFE was an error and sent out automatically. She said the medical might be in the file and if it is, end of problem. She said if it is not, though, there's not much else to be done than to redo the medical. She said they can't try to locate the medical because it might be anywhere in the vast wasteland of USCIS file storage. I hope to hear something from her some time this week.

Thanks for your help and information, Reba.

I just did the medical over. Luckily was only $130.

They did the TB test as well. I hadn't had the x-ray done before since I was pregnant then.

guys, a really dumb question. My girl is going to have her medical and she is scared to death of the whole process. Needles, doctors, the whole thing. What do they check for, how do they check for it, do they pull blood, etc? If I can sooth her it would really help.

I appreciate your answers and help !!!!!!!!!
