Anyone else adjusting status from F-1 ??

Thank you so much for all your help. I guess many of us have asked you many questions regarding adjusting status from F-1 and you have always been very helpful!! I just want to tell you that i have updated my timeline. I just got the interview appointment letter today!!! So does it mean my package is going smooth ?

Well....still waiting for the AP an EAD. It's been 2 months now, I really hope to receive the AP before Nov 15th, well, my brother is getting married, but I know, you told me before, "never leave the country without the AP"...otherwise.....oh cant imagine.....

;) I'm here just to help, I'm just paying my debt to VJ since when i was in your position, it helped me in an amazing way.

Yes, it means it's going more than smoothly, don't worry hopefully you will receive it before the 90-day limit :thumbs: You still have more than a week for it to arrive, I'm sorry if you are not able to go but see it as a step towards your GC and a long life together with your spouse.

Hello everyone ... great thread you got going here.

I'm a USC and applying for AOS for my F-1 Visa wife.

Reading threw this thread I read that F-1's have a alien registration number. What document would show this number? I look at her passport, I-94 and I-20 but cant find it.

12/30/08 Mailed AOS/I-130/EAD packet to Chicago

12/31/08 USPS reports package delivered at 11:08AM, signed by JB

01/07/09 Check for I-485 cashed

speaking of work permit, reading the instructions for form I-765 seems to me that we only need to attach 2 passport pictures. Please correct me if I'm wrong.

Also on the I-765 what category do we fall under changing from f-1 and what box do I check on the top part for

Nope,

You have to schedule an appointment with an authorized surgeon to get the I-693 before you send everything, pay attention to everything before sending it ok? details like this will cause USCIS to halt your application and send back your package or request more information that will make the process to take even longer if incomplete.

About the civil surgeon, you can find a list of local surgeons in your area here https://egov.uscis.gov/crisgwi/go?action=of...office_type=CIV, the prices tend to variate from Dr. to Dr.

It is Permission to accept employment. Even if you have already graduated and have gotten an OPT employment permit, since this "new" employment card authorization (based on your marriage to a US citizen) isn't related at all to the OPT card, this doesn't apply as a renewal.

Anyway, mark "permission to accept employment" on your form.

I'm adjusting from F-1. The only way it's easier compared to others is because you won't need to return to your home country and apply for a fiance's visa, which usually takes 6 months (if I'm not mistaken) to be processed. After being approved, you will be able to enter the US and allowed to get married and file for Adjustment of status.

Since you are an F-1, you'll be able to apply here in the US since there wasn't an intensional reason for you to come to the statues but to study not getting married. The fact that you met your sweetheart, well that's just matters of the heart and immigration cannot blame you for that.

Check my timeline for a better idea, I entered back in 2000 as an F-1, finished college and started working under the OPT work permit and while on OPT I got married.

P.S. Just make sure to get married before either your F-1 or OPT expires.

What box did you check on form I-485 part 2? H? Other? What dod you explain to them??? Thanks!!!!!

Hi everyone, new member here just found the site today.

I haven't spent many hours looking through the site yet but i did manage to find this thread and it seems the perfect place to ask my question.

My fiance has graduated and is F-1 on OPT. OPT expires in a little more than two weeks from now. I am right to say the best solution here is to get legally married and file all paperwork before the OPT expiration date?

I personally don't want to rush a marriage date as it's in no way romantic. But if it means keeping her in the country and building our new life together, then i'll do what i have to do.

Is this a fairly standard situation albeit a short timeline? Or would it be beneficial to consult an immigration/naturalization lawyer?

Yup,

Get married before she goes out of status, which is when her OPT expires. Yes, remember get married and file for AOS before her OPT card expires, getting married doesn't fix the out-of-status problem but the filing of Adjustment of Status (green card) does give her the right to legally stay in this country not just a certificate of matrimony.

I belive she will have 60-day grace period after the OPT expiration (please double check with the international advisor of her school). During this grace period, she cannot work, but can stay in the US legally (i.e., she will not be out of status). So I think you do not need to rush getting married and file AOS in 2 weeks, but have another 2 months to discuss/decide/prepare tne next steps.

She has a grace period of 60 days just in case she didn't use them after graduation, this means if she didn't apply for her OPT right after her graduation date and stayed "out-of-status" for a couple of weeks, or she didn't stopped working for 2 months in the middle of her OPT, if she hasn't used any of those 60 days, yes she has 60 days of grace period.

I am an F-1 visa holder adjusting, I arrived in the US just over a year ago to begin my studies. My husband and I met in 2005 and have lived together since 2007 (first in London, then in the US). We were married in November 2008, exchanged no vows and afterwards joined in the protests against the passing of Prop 8. We hope to have our wedding ceremony in July 2009 when we will exchange rings and vows. We filed for AOS from F-1 on 12/22/08 and received our NOA's today, I applied for advanced parole to hopefully attend my wedding in July.

Interview passed 6/30/09

Filed for ROC 6/21/11
