Anyone else adjusting status from F-1 ??

My question is what proof do I need from the employer to file this with the I-864? If it is a letter, what information should be on it?

Letter of Employment verification specifying salary, date you began working, temporary or permanent employee. Also, they ask for pay stubs for the last 6 months but since you just started, I think you will not have any. Therefore, the letter should be enough.

Also, as I landed this job with the EAD from the OPT, will the adjustment of status affect the employment?

No, it will not. As long as you have a valid EAD, you can keep on working while you await for the new EAD to arrive. Remember, if your current EAD expires before you receive your new EAD, you have to stop working.

Can I just update the EAD info with my boss after I receive the one filed with the AOS?

Yes, you can since the new EAD will allow you to work for a longer period of time in case the AOS takes some time to be processed.

The affidavit of support is what we worry about the most in filing the AOS forms, since I'll be using my income to support myself, will that significantly affect the USCIS's decision during the process? As I just started working in March 08, I don't have my tax return for 2007, and my husband's income for the last three years does not meet the required line, since he is a student and works only part-time.

As long as you can prove that you surpass the poverty line, I see no reason why they would make a big deal about it. Requirements are requirements and if you fullfill them, why would they deny you, moreover since your husband is a college student, it's understandable.

Last but not least, I'm thinking about taking my husband's last name, but should I wait until everything goes through and change it when I become a citizen? I'm just afraid that it would be confusing as all my previous documents are in my birth last name.

Either way, just remember the name you put on the application for AOS is the name that is going to your green card and the one that should go to your SS Card. Of course, since you already have one, the SS Administration won't have any issues on changing the name based on marriage. The green card's name can also be changed but you have to pay on your receive it to get it replaced and modified. Save yourself the troubles and expenses, and make a decision now.

Thank you so much in advance. Sometimes thinking about what we have to go through to stay together gives me a headache, but we'd like to think that it's a test for our love and commitment together. That makes it all worth it. Thanks so much for your help.

I know it's a pain in the behind but it's all worth it, besides as they say, achieving something difficult is better than achieving something given away. Good luck on your AOS and don't be afraid to ask if you need to ;)

Don't know if you're checking this frequently and don't know if you remember me but I emailed you about 1 1/2 months ago to ask you a couple of questions. I wanted to thank you for your thoroughly helpful responses. I finally mailed off my application materials last Friday. It feels like a ton of bricks have been lifted from my shoulders :) but now the waiting game begins.

I have one last quick question to you or anyone else who might be able to respond. I know the average time to process the advance parole (I-131) is 70 days, but does anyone know for those of us who are adjusting from F-1, if that process goes a tiny bit faster for us? I have tickets to return to Malaysia December 26 this year and we must go home because my dad's only going to turn 60 once and there's no way I'm missing out on that. I know it varies, but for those who got theirs done pretty quickly, can you tell me if there's anythig in particular that you did (e.g., called USCIS, filed emergency AP, etc.?) Any input helps and any positive stories will help "ease" my worries as of right now. I am trying to remain positive since I think I have a pretty strong case, I believe. I've been an F-1 student since 2001, and as you did GueraYTavo, I checked and double checked every detail before I sealed the envelope and mailed it off!

11/3/08 - Called the USCIS Customer Service center and asked for an expedited processing of AP. Customer service agent was extremely nice and polite. I told him my circumstances for the request (i.e., we had purchased tickets, family medical situation, planned wedding reception back home) and he submitted the request. He thought I had good reasons for my request to be granted.

11/6/08 - Saw online that my AP has been approved. YAY!

11/12/08 - Got my AP in the mail, 9 days after my request for expedition, not too bad!

Wrong, the average time to process the AP is 90 days NOT 70 and it doesn't process faster than other people's just because we're F-1's, the reason for a faster processing might be because a more efficient immigration officer is handling the case.

After the 90-day waiting period you can schedule an infopass and ask about your case, that's as much as you can do. Finally, you have to keep in mind that the "no way I'm missing out on that" mentality won't work, there is no way that you will be able to leave the US without your AP, if you do, you can be denied entry back into the states for failure to show the proper documentation. Are you willing to risk your AOS for a trip? ;)

Hi guys, thanks for all the valuable info sharing! Deeply appreciate it:-) I got tiny question - may sound silly, but it's stressed during this waiting period - so hope someone could throw a light... I sent in my I-485/I-130/I-131/I-765 package and it's been received on 10/14/08. I havn't received any NOA receipt yet, but finally yesterday (10/21/08) they cashed my husband's check for I-130. However, the check for I-485 hasn't been checked - is that "normal"? I browsed so many posts, and it seems that everyone's checks for I-130 & I-485 are cashed SIMULTANEOUSLY, aren't they? Could anyone give me some advice? Thank you in advance.

P.S. My husband his check for I-130 and I wrote my check for I-485, we did it since we thought he's applicant for I-130 and I'm applicant for I-485, so by doing this won't get confused. But would it affect anything?

Do not give it too much thought, since they already cashed a check, it means they received it and they will be cashing yours in a couple of days, I do not see any problem on sending checks from different banking accounts, I also didn't see any problem on sending both checks from a sole bank account. Anyways, stop stressing and just overthinking, a check is a check and money will be money for USCIS.

I just want to tell you that i have updated my timeline. I just got the interview appointment letter today!!! So does it mean my package is going smooth ?

And yes, Guera is right. Do not leave without your AP! Why risk it when you are so close?
