Anyone else adjusting status from F-1 ??

Hi everybody,

Today, my case has been "touched"...but mostly because they wanted more evidence in my I-485 case...Last time they sent an RFE, it was about the sponsor thingie...hope that this time it is not about the same thing, because we are pretty sure that we filled out everything...:(

so the case is now suspended....it is depressing :(...but oh well....now i know that they haven't lost my case...

For those whose case hasn't been touched for a long time, just hang it there, because they will one day like mine...after 6 weeks of patience XP...

Not being touched and left in the dark is the most depressing thing ever.

I am thinking about making an infopass appt if i don't get any interview letter by the end of june. I can't just have my life left in limbo. Give me something USCIS, anything.

My wife came here on an F1 visa and has in the country for over 12 years. We had the AOS approved on Friday. The only question they asked was how we met. We met while we were training for the Chicago marathon in 2004. There was nothing to our interview and it lasted about 5 minutes. It was mostly verifing address info, correcting a birth date and making sure we will send in the paperwork in two years to remove the conditions. They just want to make sure your marriage is for real and not just to stay in the country. My wife has a year left in school and she will get her Doctorate in Biomechanics. He pretty much told that she didn't need to marry me to stay in the country as any employer would do the paperwork necessary to keep her here. :)

My wife came to the US on an F1 visa about 10 years ago.

I'm new to the boards and after a week just now found this thread. Thank you for starting it!

Not much, I came back in 2000 on an F-1, met my wife while in college, finished college in 2007 and applied for the OPT and got it on June 07 (valid until June 08). While I was working through the OPT, we got married. See my timeline for more information about dates.

Our interview lasted about 10 min, they didn't ask my wife nor myself any personal questions but just the usual NO questions related to prostitution, communism etc. He asked to see our latest income tax, birth certificates and my student visa and we got approved. ;)

Let me know if you need something since I pretty much filled out all the forms w/o any help from any lawyer :thumbs:

Hello,

Quick question for the Gurus on duty. We applied for my wife's AOS this week. Whole package. She is current a F1 and I'm a US citizen. I understand that as soon as we receive the NOA for 485/130 her status is no longer F1. Is that right? Or you have to wait for the EAD? Asking this because of the fall registration at her school. She will have to register in July but she want to change the pace and not register for all UCIS required credits (minimum of 9). We have a 1-year old boy and she want to rest a little.

1- Can she request to be removed from SEVIS and all the international student requirement as soon as we have the NOA? Or we have to wait for the EAD?

2- Does that requirement change from school to school? She is current having her Master.

3- Is she removed from SEVIS automatically?

I would appreciate any input. And thank you very much!

The moment your receive the NOA, she stops being an F-1 since you will receive an original document that can prove she is in process to become a permanent resident.

1. Yes, she can request to be removed from SEVIS since she is no longer an international student but a foreign spouse adjustmenting of status.

2. She will stop being a student if she has filed for AOS no matter what school she is in.

3. I'm not quite sure that's automatically but I guess it's not because I became a permanent resident on April 08 and I just received a letter for the Office of international programs requesting information regarding my OPT employment, I politely told them that I was already a green card holder so I didn't need to send anything anymore :dance: ohhh yeah! finally :innocent:

Thank you very much for the prompt answer. On the same topic:

- does that mean she no longer has to register for all USCIS minimum required number of credits next fall? I guess so, right?

- will the school understand that situation and accept the "adjustee" status allowing her to register for less credits or not register at all and flagging her name on SEVIS?

- during the green card process itself (while runing) won't that be a problem since USCIS could try to check her I-120 before the interview and get at abandoned/or similar flag on SEVIS? Or only at the time of the application she would have to be in status.

I'm in the same predicament (only I start another grad program in Sept at a different school).

1. It really depends on the school. Some want you to maintain status to attend, so they'll ask that you keep your I-20 record up-to-date and maintain the SEVIS information (if only to protect themselves). Some will only remove your SEVIS information if you have a physical green card to show. It's no harm keep the I-20 current but I don't suggest that she "fall out of status" with them, even when she's no longer techically on F1 status.

2. It's really tricky and no one has a definitive answer, technically she violated her F1 status so it shouldn't matter but for the school's purposes she is still an international student until a definitive change in status.

3. She has to request to be removed from SEVIS.

- I wouldn't suggest she do that but she really needs to speak to her International Student Advisor to see what the school requires. Mine still wants me to maintain status and a full course load until I get the green card.

- I think there's a SEVIS status called "Adjusting Student" or something like that, tell her to ask about that. She *may* be able to use that to take a lesser course load. Or at the very worst have her explain her situation and she should be able to take a lesser course load with permission for the International Student Advisor

-She should be in current F1 status, they would WANT her I-20 to be valid and her SEVIS information current to prove she didn't overstay her visa, that's actually a good thing :lol:

I am planning to send the following forms in one package: I-130, I-864, I-485, I-131, I-765, G-325a. Is it OK to send them all at the same time? Do I need to attach passport type photos? I am on my OPT now and I remember when I filled out I-765 to get the EAD last year I also attached photos to the application. Thank you!

Hi,

I'm also adjusting from F-1 status and just got married on June 27th. I'm currently on OPT, and have some questions on the affidavit of support.

My husband is a student, and his income does not exceed the 125 percent poverty line. To make a long story short, no one in his family will be able to file as a co-sponsor for us either. However, from the instructions on the form, I read that the intending immigrant can contribute to the household income. I have just been offered a position with a salary that will make our combined income definitely exceed the poverty line. My question is what proof do I need from the employer to file this with the I-864? If it is a letter, what information should be on it?

Also, as I landed this job with the EAD from the OPT, will the adjustment of status affect the employment? Can I just update the EAD info with my boss after I receive the one filed with the AOS?

The affidavit of support is what we worry about the most in filing the AOS forms, since I'll be using my income to support myself, will that significantly affect the USCIS's decision during the process? As I just started working in March 08, I don't have my tax return for 2007, and my husband's income for the last three years does not meet the required line, since he is a student and works only part-time.

Last but not least, I'm thinking about taking my husband's last name, but should I wait until everything goes through and change it when I become a citizen? I'm just afraid that it would be confusing as all my previous documents are in my birth last name.

Thank you so much in advance. Sometimes thinking about what we have to go through to stay together gives me a headache, but we'd like to think that it's a test for our love and commitment together. That makes it all worth it. Thanks so much for your help.
