Maybe somebody will verify whether the son must enter and/or file to adjust status before he turns 21. I don't recall past discussion on that issue.

Well, we know I don't know the answer to that :lol:

But if that's potentially a problem, Richard better find out pretty fast. If the son is 20 now and Richard and Li don't enter the US for another few months, he could have his birthday at any time...you might end up having to get married right away instead of waiting a month-three months so the son can adjust his status right away.

But this sounds unlikely to me. I'm assuming there's a rule that the child can only apply with the beneficiary if he/she is under 21? As unreliable and unpredictable as all of the petitioning is, I don't see how the US gov. could require that a 20 year old who files still be 20 when he enters, when it takes some people years to get their visa.

But besides all that...I really just wanted to say that I don't think Li's son will have that bad of a time adjusting to things here, or I hope not :) Especially if he speaks english well already, then that's the biggest hurdle over with.

I think he should be fine in succeeding in the US. It sounds like he already has a good head on his shoulders. If he's still not sure of what he wants to do/where he wants to be, the US is a pretty huge place. He can always save up a bit of money and go "find himself" from coast to coast; he's bound to find something he likes :yes:

Let's not muddy the waters with supposition and error. The US government absolutely can and does require that the K2 visa be issued before age 21 or no visa. They do, however, have expedite procedures to deal with age out issues where possible.

What I don't know is what I stated in the previous post and YES, they need to find out ASAP. I suspect somebody who DOES know, will be along shortly.

  • 08/03/07 Received NOA1 from the CSC.

  • 01/23/08 NVC sent our case to U.S. Consulate in Guangzhou China.
  • 03/31/08 U.S. Consulate in Guangzhou China received, issued case number.
  • 04/05/08 P3 received.
  • 04/06/08 P3 sent.
  • 05/01/08 P4 received.
  • 05/12/08 Flight to China.
  • 06/23/08 Interview at U.S. Consulate in Guangzhou China- PINK.

One thing I am going to ask you to consider is "aging out". Many children of K-1 applicants, when applying for AOS, "age-out" before the card is issued.

This is something I recommend looking into before you bring the son over here. There is a member here who had to fight tooth and nail through the courts to keep a child here who was under 21 at time of application, but over 21 during AOS. I'll see if I can find it.
