I-130 was filled two years ago, becoming US Citizen.

Hello everybody, I am fairly new to this Forum and have been reading some of the posts and probably should thank you everyone to create such a helpful environment.

My story is like this: we got married in May, 2004 and then in March 2005, I applied I-130 based on my Green card to CSC.

Now, I will be a US Citizen soon ( hopefully by next month) and I just want to make sure that after all these four years of separation by law ( of the US) I won't add more separation time myself, therefore want you all to give me some hints. Appreciate all that in advance.

As I said, I filled the I-130 to California Service Center and then when I get my Naturalization Certificate I should send a copy to them as well. But question is where should I file my I-129? In the form says CSC, but what is the Chicago Lockbox?

I searched for the DCF requirements to probably expedite this process time, but I am not eligible for the six months residency, is there anyway around it?

Have anyone here actually went through this process of filling base on your GC and then upgrade your case and being able to bring you spouse here?

Thank you guys for reading my post. I hope you will help me.

Peace.

Your post is a bit garbled, let me see if I understand correctly:

You are a legal permanent resident of the US, and you have submitted an I-130 petition to the CSC to bring your spouse here with you, right?

You are now eligible to apply for Naturalization, and once that is done, you wish to upgrade your I-130 to that of citizen petitioning for spouse, right?

What country are you from originally, and what country is your spouse from? This may also help someone answer your questions

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!

Yes,

We are both from Iran but since there is no American Embassy there, we got married in Turkey (May 2004).

I want to see if there is one person who applied I-130 based on their GC and then upgraded the form by their NC.

Thank you

Hello nimche,

Yes this was my story as well! We got married in Lebanon on May 13, 2006 while I was undergoing my citizenship process, I submitted my I-130 in November 2006 (war broke out and that's why I submitted my I-130 so late) then I finally was sworned in to be a US citizen on July 24, 2007. On this day I called USCIS to upgrade my petition and submitted my I-129F (K-3 visa)... For some reason though I think the K-3 visa delayed my case for my I-130 because I just got approved 2 weeks ago and my k-3 was not approved! Last USCIS rep I talked to told me that they changed their k-3 guidelines. I would ask more people's opinion about submitting your k-3 visa petition. Also keep in mind that we were in secruity checks for almost 3 months. I saw a case that once he upgraded his petition it was approved within 2 months and he didn't submit a I-129F. I think looking back if I would have done more research or know about VJ I would have not submitted the K-3.

Good Luck in your journey!!!

Thats crazy. I can't even imagine to wait longer anymore. yours seems to take a lot longer than usuall and it is not even done in NVC yet and I hope they will do something about it.

BTW, thank you for sharing your story.

Q1: You didn't send a copy of your Naturalization Certificate to ask them to upgrade your I-130 to Citizen applicant? I mean upgrade just by calling in was enough?

Q2: I have seen several other places which people said, K3 visa has delayed their cases or recently started to happen in new cases, Do you think I should just stick with only I-130 and that is it. Do you know who should I contact to ask more questions about this situation?

Thank you in advance.

They didn't ask for a copy of my certificate when I called, but I did mention that I was going to be sending my I-129F petition in with a copy of my Certificate. I didn't get approved for my k-3 visa (don't ask me why) and I am still waiting on my case number at NVC. Inshallah we get it soon..... Thank GOD we got approved finally but it did take a while because I was told my husband country was a "Country of Interest" to US. They had us in Security checks for about 3 months, so I am thinking that's why it took so long.... You can call USCIS customer service number to ask them questions, or you can ask advice from a lawyer. I wouldn't pay a lawyer though, my opinion they do what we can do for our cases.

Hope this information helped a bit.
