AOS questions - for those who already filed

hello everyone! first of all, i really miss posting here in VJ! it's been a while since i posted. been really busy with all these stuffs for our church wedding preparation on april 19. wheeeewww!!

anyway, we are planning to file our AOS application together with the EAD application a week after our church wedding. so, i have below are the boggling questions on my mind about AOS filling:

1. On the Form I-485:

a. should i put my maiden name or my new married name on writing my family name on part 1 of the form?

b. on part 3, section b, on the A# question for my husband, do i need to put his driver's license number?

2. On Form I-864 (affidavit of support)

a. we are getting a co-sponsor, we'll be having my husband's cousin as a joint-sponsor, will it be possible even if she does not live with us and she is his first cousin?

b. as a joint sponsor, does his cousin needs to fill up another I-864 aside from the one that will be filled up my husband who is the principal sponsor?

c. if we will be having a joint-sponsor, how many form i-864A (contract between the sponsor and household member) do we need to submit? do we need a form i-864A for me and my husband? and then another one for his cousin and me?

d. do we need to notarize the form i-864?

yes it's best to put your married name already [if that's the name you want in your gc] and that have your maiden name as your middle if you want like the way we do it in phil (that's what r.bacon advised us to do)

b. on part 3, section b, on the A# question for my husband, do i need to put his driver's license number?

i dont think so since DL# is different from A# (which Alien# i believe is a person whose an immigrant like us or not a US citizen)...[we wrote n/a i believe for my hubby]

a. we are getting a co-sponsor, we'll be having my husband's cousin as a joint-sponsor, will it be possible even if she does not live with us and she is his first cousin?

what i know is that as long as the person qualified or above poverty line then its ok regardless if its a family member or not (although people can correct me if im wrong w/ this)

b. as a joint sponsor, does his cousin needs to fill up another I-864 aside from the one that will be filled up my husband who is the principal sponsor?

i do believe so. that he needs to file a separate set (but since we never had a co-sponsor im really sure about the correct steps. so i couldnt be so sure)

d. do we need to notarize the form i-864?

i dont think that it should be notarized. but base in our AOS, we didnt notarize anything (cept for the marriage cert which is notarized automatically from the county record)

I can only help you on the Form I-485 since my knowledge with AOS is limited.

a. You need to use your married name.

b. The AOS is "your" application, means, your husband doesn't have to fill up any of the forms.

The rest of your questions, I'm sure others can help you with it. But one thing I know of, it's not I-864 form for co-sponsor, if I'm getting it right, I think it's I-864EZ (???)

The first one, filled out by Carl, check the first box "I am the petitioner"

The second one, filled out by the co-sponsor, they fill it out and check "I am the co-sponsor"

Hi beng!

my husband and I just finished filling up our AOS form.

if you look in the Visa issued to you by the US embassy, on the left lower hand corner, there's an A# stated there. Mine has 8 digits. It says there A# 89 *** ***. That's what we were instructed to write down in the forms asking for A# or Alien Registration Number. But i came in a K3 visa, so i'm not sure if it's the same with a K1 visa.

Use your married name in filling up the forms because that is the name that will appear in your green card

the I-864 need not be notarized.

I can only help you on the Form I-485 since my knowledge with AOS is limited.

Im glad I found this thread but at the same time now worried because thru inquiries ( I even posted a thread here ) from here and from my friends who filed their AOS earlier than me, I was adviced to put my unmarried name on the AOS forms and the EAD too. I have my EAD now still with my unmarried name on it.

Is there a way that I can rectify the situation so my married name will be reflected on my green card?

would not use I-864A since the cousin does not have the same principal residence as you.

i looked at my I-485 on part 3, sec b (list your present husband/wife)... although you're the only whose filing but you need to fill up your husband's info. and under A# i put NONE

I already did and the good lady said I have to submit a request letter and attach proof of the change of the entry. Also I talked to my other friends who are in the same situation and we can request the change during the interview if we have one. . now I hope we will have an interview so we can make the request.

hey jom! i was gona mention that during my interview, the officer asked me what name should i be using in the GC (knowing there's a big chaos/confusion in my name lol)... so i told him exactly what we wanted to put in my GC as i also wanted to put in my driver's license also... hopefully they'll do the same to ya! which i think they would!!! good luck and God bless!!!

This is really great news for me!! Thanks. I know a lot dont want an interview but I WANT ONE, lol, then I can request also for my married name to be on the green card. Take care!!

You dont need to use your husband's name in your application. It depends on which name you would like to carry after marriage. I continued using my maiden name for professional reasons, so i put my maiden name in my AOS application. However, if you want to change your name after marriage then, use that when you apply for your AOS. Have fun on your wedding!

i put none under my A# and wrote my I-94 # at the back of my photos.

no, you did not use public assitance when you got your Td shot. I think they listed something like food coupons and social security benefits under this "public assistance" thing. so, you're good...

Read the following post only if you dont have a job yet or if you're interested to read it....

Regarding your EAD, if dont have a job yet but plan on getting one, you dont have to wait for your EAD, as long as the people who handle your job application know what they're supposed to be doing i was able to get a university position a month after my arrival even without EAD. if you read the SSN website, it says there that we dont actually need an EAD because we are actually entering the US with the assumption that we will be living here. K1 visa holders have authority to work from INS, its just not put on our passport or visas, but it is in their handbook(i think). however... when you get your SSN, they will print "valid only with INS authorization"

when i filed for my documents at work, they have to send me to the international students office in my university (which was mind-boggling because i am not a student, i am an employee). i was quite lucky because the person who entertained me was quick minded and told me that even if the SSN website stated that we dont need an EAD, the INS is a completely different entity and that they have different rules. then he said the handbook from INS actually allowed us to work too (phew!). The only hindrance for your being accepted at work is actually the personnel handling your employment application. a lot of them are not familiar with immigration rules and will actually give you a hard time. The human resources at our department didnt know what they were doing so they have to refer me to someone who is more familiar with my case, but i was lucky to be forwarded to a knowledgeable person. I dont have my EAD on paper yet but im already working and will just be forwarding the adjustment papers to our human resources when i get them because they have a record of my I-94 expiration.
