Hello,

I'm currently under OPT (exp May 31, 2008) I read on USCIS.com about a 17 month extension of OPT for highly skilled foreign students. After I read all the requirements, I think I'm qualify for getting that extension.

My fiancee (US citizen) and I are getting married this week and after that I'm gonna apply for AOS and EAD.

My question is if I get granted for that 17 month OPT extension, can I use that OPT extension OPT to work while I'm waiting for my EAD to arrive(EAD that I'll apply under AOS) and while my AOS is being processed?

As long as the OPT is valid, you should have no problem working while waiting for the EAD. However, if there is a waiting period in between the OPT and the new EAD then you cant work for that period of time. I dont know how strict empoyers are about this. Hopefully that helps
