Timeline

Is it necessary to have my wife added to the mortgage on our house as proof of residence for removal of conditions? We have many other proof, bills, affadavits, letters and photos so on. Do we need this also? The reason I ask is that there is a fee involved and great deal of paperwork that is needed done to do this, and if it's not necessary we don't see the point in doing it.

I personally dont think its necessary. Im not listed on our mortgage. When we purchased our house I was still awaiting adjustment of status and therefore they wouldnt do it. I was added to the title on the house though. I dont think this is such a big deal to arrange if you wanted to do this. I beleive it is through a Quit Claim Deed which is registered with your county. You may want to consider this as from what I was told, if something were to happen to my husband the title on our house automatically goes to me.

Someone else might be able to give more info. Its been a while since we did this and I dont remember the specifics of why it was a good idea.

My DH isn't on the mortgage, its in my name, but we sent in the Deed of Trust (same thing as what above poster said). It states that we both own the title (when we get it paid off in a million years) and should one of us die, it goes to the other.

I don't think it's essential if you have lots of other strong evidence. But - at our AOS interview the moment the Immigration Officer saw our mortgage he commented "excellent, this is the best evidence for us and with this you will have no problems when you file to remove conditions" that is honestly the comment he made.

However I also think the property Warranty Deed showing us as joint owners was just as valuable, so if that's easier to do then why not just do that instead.

But if you have joint bank accts, savings, credit cards etc....he also commented that it's the financial ties they look for more than anything. So in that instance I would not worry too much about property. We also had Wills and Life Insurance which showed beneficiaries too.

A Quit Claim?? You had better read what you signed. A quit claim means that you gave up (quit) any claim on the title of the property...although you are still responsible for the mortgage. Do NOT quit claim your property....go to a Title Co. to properly transfer title to JOINT if you are sure that you want to do this....do it with WRTS (with rights to survivorship) where the surviving partner can take title immediately without having to go thru probate.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Interesting point. When I talked to a mortgage guy recently about refinancing and adding my wife to the title/mortgage he said one of the additional documents would be a Quit Claim. I assumed it was necessary to do that to add her.

In line with previous posts, it is not strictly necessary. We were just approved without my name on the mortgage or the title to the property. I did include the mortgage docs and other bills that are in my name to show that we both live at the same address and share the burden of the cost.

It is always tricky when deciding whether to put more money into this already expensive process, my advice is to look at your evidence already gathered and try to objectively assess how strong it is and whether the mortgage docs will make a big difference.

I didn't add my wife to my title - (the house is clear) and have filed for everything without using this portion of the 'evidence' - so far no problems. Also, yes you can do a quick claim to add your wife or someone else to your property - it cost me just $8 through a local Remax office - a friend I know used to work there and called to set up my appointment. (I did a quick claim to add my sister to my property and she did a quick claim to add me to her property - so we can dispose of each other's property in case one of us was to die.) I believe I have enough evidence - like bank statements, credit cards, health insurance, utility bills to tie us up sufficiently. Good Luck

We have sent mortgage statements. However, it was on my name only since my credit history was better and adding hubby's name to mortgage could increase interest. The title company said that they cannot add husband's name to the deed since mortgage on my name only (reading BRAD836 post-make me think that title company just forgot to add husbands name and came with this excuse at closing). However, it is a marrital property in PA-even if it is on my name only, i cannot even sale it. We added to I-751 package mortgage bank paper work showing that they been working on joint application, but better terms were available only for mortgage with my name only.

My husband bought our house before we met and has a wonderful mortgage rate on it. We would have had to refinance to add my name to the mortgage so we definitely didn't want to do that as we would not get as good a rate. Georgia is a joint ownership state (I don't remember what the exact phrase is) so that means that through marriage I automatically gain rights to the property and don't have to go through probate if anything (God forbid) happens to my husband. I basically stated all of that in my covering letter and then provided LOTS of other evidence to show we have tied our lives together financially, socially and in all ways. You should be fine, especially if you have lots of other evidence. (We did include as one of the bank statements one showing the mortgage payment automatically coming out of our joint account . The bank statement also showed activity from both of us on the same account).
