Affidavits for I-751

Hey guys,

Can I just confirm one thing? I'm putting together my I-751 package and unfortunately I will be filing as a divorced couple. I have two affidavits from friends stating that the marriage was entered in to in good faith etc.

Do these have to be notarized? Is it essential?

No - they just have to state that 'I affirm this is a sworn Affidavit' before the signature, they must also state their full name, date and place of birth and that they are a US citizen.

Actually (assuming you can't get your friend before a notary), federal law requires that the declaration be in "substantially the following form":

I declare under penalty of perjury that the foregoing is true and correct. Executed on (date).

(Signature)

The key here is that, whether by this declaration or an oath before a notary, the person is under penalty of perjury.

My lawer said that affidavits are not essential and not needed. But on your place if you still want to include them I would check more-because i have read that they have to be notorized and should be from GC holders orUS ctzns.

My lawer said that affidavits are not essential and not needed. But on your place if you still want to include them I would check more-because i have read that they have to be notorized and should be from GC holders orUS ctzns.

your affidavits have to be notarized

we are in same situation

get as many affidavits as you can..if family members then it would be great

wish you good luck for your I-751

Timeline

hi, Im in the same proccess, i got them notarized, i got a question though, do i send the originals or copies? ty

9-29-2005 - Sent off K1 Petition application. my brithday!!

10-03-2005 - Vermont received package

case number in the back of the check (bank online)

never Received NOA1 in mail

10-20-2005 - approved- SO SO HAPPY!!!

10-26-2005 - got NOA2 in mail saying the case was sent to NVC

11-01-2005 - got a letter from NVC saying the case was sent to Bogota embassy in oct 28th

11-04-2005 - got package 3 on Bogota and faxed DS-230 and OF-169, i will send them to the embassy too.

I would send originals and keep photocopies for record.

It does not have to be notarized, but notarization looks more official, in my opinion.

Yes, it is not essential, but it does strengthen the evidence.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
