Please correct the section of the K3 flow chart that indicates they apply for AP. AP is not needed and is unavailable to K3 visa holders.

If you read the flow chart it states:

"You may also file for your EAD and AP (if K-3 visa expired) at this time."

So basically people may need to file for AP if their K3 is expired.

Another correction for the K3 guide. For the EAD application:

the guide says this:

While holding a valid K-3 (not yet applied for AOS). As a valid K-3 visa holder you may apply for an EAD based solely on this status. You will apply as a category (a)(9), K3 non-immigrant spouse. (Where: by mail -- to Chicago ONLY; not to your local office)

the EAD application instructions say this:

If your response to Question 16 is:1. (a)(9), admitted as a K-3 spouse or K-4 dependant; or

mail your EAD application with the required fee to theappropriate USCIS service center below:
