Hey Everyone!

I am new to this forum, but I just want to say what an amazing place!

Anyway, I am the US Citizen and my fiancee is portuguese, and we filed

everything on February 7, 2008 (AOS, AP, EAD, and I-130). She already

was here on a valid F-1, so we didn't go through the whole fiancee visa

process.

I was wondering, if you will note in my signature, since we had an RFE

for the medical exam in early March, and had wrapped everything up

by March 21 getting it all back to the CIS, should this delay the advance

parole? Having read quite a bit on here, I have the impression that an

RFE for medical exam only delays the AOS and EAD, but shouldn't delay

the AP. Is that correct?

Also, based on my signature, should we expect that everything needs to

be transferred to a Service Center before stuff will start getting approved?

I.e., does the NBC approve AP and EAD for applicants like us, or only

at service centers after transfer? Since the nearest office is Detroit,

which service center will our stuff likely get transferred to?

Finally, it is reasonable to expect, based on what is in my signature, that

our advance parole will be approved soon? I have that impression, but

I really have no idea. That is our biggest concern, since we need to have

that by the beginning of June (the earlier the better), since we are traveling

to Portugal for the religious wedding ceremony.

Based on your signature I would say that your AP and EAD will be approved on the month of May if you are lucky. It currently takes around 90 days to be approved. This reasoning is based on my signature. Based on your signature, no, an EAD won't delay your AP process, look at my signature.

Based on your signature, no the only way everything will be approved is if the applications are transfered to the California Service Center and you will not need an interview to get approved. Based on my signature you will see that we never got transfered and were scheduled for an interview, up to that point our paperwork I guess will be sent or it is already here in my local Service Center.

Again, with immigration nothing is certain or written in stone. Each and every case is unique and each and every outcome may differ as well. This commentary is not based on my signature... :P

Sorry, I am confused by your response. Thanks for making fun of my use of the phrase "based on my signature," which probably caused most of the confusion, but I was just trying to be economic with information since my post was already long enough.

Why is it that people are already getting their APs approved with filing dates only about 1-2 weeks earlier than mine, yet I shouldn't expect to get approval until mid-May?

Is not that you should expect it by that date, it should take a "maximum" of 90 days. If you receive it prior to that period of time, well, be grateful. The 90 days period only serves to give you an idea of the waiting period and also to contact USCIS in case it takes more than that.

That's ok, it's just that it was too repetitive and well I was just trying to be funny. No harm intended :)

Well, it says 90 days right on the NOA for my AP, so that's not really any new information.

I think the whole point of this web site is for us to provide each other with more information

than what the governmentis giving us at this point. It is pretty clearly quite common for

people to get AP approval well in advance of the 90 day estimate, and I am just trying

to get an idea if there are any reasons specific to my case, from the information that I

have provided, that my AP should take much longer than anyone else, which of course

appears, CURRENTLY, to be much faster than 90 days.

Another question, the processing times for AP on the USCIS web site for the National Benefits Center say that they are currently processing applications filed December 26, 2007.

Is this information even meaningful for my case if it needs to be transferred before anything can be approved?

Well buddy, I didnt apply for an AP but my EAD (normally EAD's and AP's within the same period of time) took the 90 days just as the NOA stated. As you mention, people might get them before but nothing is certain with USCIS, people that applied at the same time as you did have already gotten theirs well, but I'm pretty sure that not all of them have, it is just a matter of how efficient your immigration office on reviewing cases i guess.

Naaa is not useful at all because there are people that have already received their EAD's and AP's and they applied on February.

I have another question. As far as the AP goes, it is most important that my wife is able travel at the beginning of June. Does she actually need to be here for receipt of the AP if I will be also?

What I mean is, for example:

She leaves June 1st to Portugal

AP comes June 10th

I leave June 15th with AP and give it to her in Portugal

Can she come back with it without abandoning her application

or does she actually need to be in the US when it issues?
