Hi there,

Can anyone help me figure out where to begin in getting the criminal background check for my Canadian husband? How long does this take and how do we go about it? Another thing.... will he have to get some sort of "waiver" if he has something on his record?

Waiver needs to be filed if something on the record makes him inadmissible, and can only be filed at the request of the counselor officer at visa interview.

Im not sure about the waiver.. I had criminal charges but they were not serious and I passed my K-1 interview..

He had a DUI about 13 yrs ago and then an assault charge from a fight about the same time. Would we need a waiver for either of those??? We are doing an AOS... don't we need the criminal check from Canada for him to send in with our packets??? I'm getting confused here.

is this for an interview?

if so you can get one form a Canadian consulate..

That's a State Department link for visa processing. That has nothing to do with stateside adjustment of status.

Still explains how to get police report when not living in home country.

But, yes the AOS guide does not specify that a report is needed.

I am reading the Instructions for the AOS (I-485) and it states that you need copies of any criminal charges. I am getting confused.

That's a State Department link for visa processing. That has nothing to do with stateside adjustment of status.

Still explains how to get police report when not living in home country.

Which means probably that you'd need to get a copy of the file from the court.

Im pretty sure there IS NOT an RCMP office in the US.
