Hi,

I have several questions, so I hope none of them are redundant (I have looked at the guides and FAQs already).

1. I keep trying to download several of the forms and they won't open, saying the file might be corrupted - I've tried both thru VJ website and the USCIS - anyone have any idea how to get a good copy of the forms I485, I864P, I131 and I765?

2. Does the I864 have to be notarized - it's not clear from the form? And the I485?

3. My income is not enough to sponsor my husband alone but I do have assets. Should I even fill out the assets part of the I864 if my mom will be co-sponsor?

4. Should she give extra financial evidence beyond her most recent tax return? Could she send a copy of the employment letter she sent for the I134 several months ago? Do the three years of tax returns and recent pay stubs really make a difference in the application?

5. Is it Ok if we file past the 90 days of his KI visa? We will be married by then but I'm not sure we'll have the marriage certificate.

6. My husband seems to have a very limited vaccination sheet that he brought with him from Cuba, since the big medical packet was retained by the immigration officials when he entered the country. The sheet doesn't specify all his vaccinations. Do I need to get them all done again here?

Thanks!

1/ check your firewalls, clear your cache and cookies and try again.

2/ No

3/ Do not need to fill in assets if your co-sponser has sufficient financials.

4/ Some send only the latest tax return some send 3 years, If the information has not changed on her employment letter then should be ok for that. The more information the better to send is my opinion, but you must send all supporting evidence that they ask for on the applications.

5/ No problem, your K1 condition is that the marriage takes place within 90 days, you may file whenever convenient.

6/ He can have a titre test to determine which he has immunity to or have them done again and then take the vaccination record to a CS to transcibe onto the supplement. He does not need a full medical.

1 Try re-installing Adobe Reader, the current version is 8.1 http://www.adobe.com/

2 NO

3 Assets need to be liquid like cash, and need to be 3 times your income short fall, that is if income is 1000 below 125% povertyline then assets need to be 3000.

4 We reused employment letter from I-134 as well as included copies of recent pay-stubs.

5 This one of the most asked questions on VJ  it is not a problem to file AOS later that the I-94 expiration, just keep in mind, that time your spouse is Out-Of-Status, filing ASAP protects status.

FAQ: 6.1)...How soon after we get married should we apply for Adjustment of Status?

6 This is a question to ask the US Civil Surgeon that you will be visiting to get the vaccination record transfered to a vaccination supplement.

I-864 needs to be notarized - look at page 6, part 7. I485 - no notarization needed.

Dont confuse the OP, it does not need to be notarized, there is NO Place on form I-864 for a Notary.

http://travel.state.gov/pdf/I-864GenInfo-FAQ-Final.pdf

Are the Affidavit of Support forms required to be notarized?

No. The sponsor just has to sign the form. You should know however, when the sponsor signs an Affidavit of Support form, he/she certifies that the information provided, transcript and/or photocopy of tax documentation is true and correct, under penalty of perjury.

Regarding your last question about the medical part. My husband also only had his vacination record that he brought from Cuba. We ended up finding the closest Civil Surgeon and called to ask questions. Then we took it in and they were able to fill out the necessary form for the AOS and give it to us the same day. We did not have to translate, though I am not sure if this is the case in all places. Good luck!
