I am new here and I need your help here. Here's situation we're in now:

We got married in China in June, 2007

My husband hired an immigration lawyer to handle this in July,2007

His daughters were silk and he needed to pay the hospital bills, and this delayed the time he paid the lawyer, and lawyer let him go in Nov, 2007

He started handling it himself, he applied for I-130 for me.

He turned in all paperwork in interview in Jan 21, 2008

We got the reciept number from immigration in Feb 19, 2008

He sent back the package with the reciept number and Form I-129F, is going to apply for K-3 for me in Mar 26, 2008

He got the package sent back for the original paperworks in Apr 6, 2008

He serves in U.S Army and about to get deployed overseas soon.

I am just so worried about all these immigration stuffs, cause we plan for me to be in U.S. and waiting for he comes back from overseas after about 1 year. Anyone here has ideas about my questions as below ?

He's going to send back the package with original paperworks as they asked for, but what else additional Forms or Paperworks he needs to put in with the package as well ?

Does he has to go to interview for K-3 ? If yes, what we have to do when he cannot to attend the interview due to he'll be overseas ?

Do he need to send 2 copies of form DS-156 and one form DS-156K when he send back the I-130 receipt number ?

Does he need to send me forms I-864 and I-134 that filed by him and the joint sponsor with original signature in case I might need them for my interwiew in China ?

Sorry about so many questions, but everything for us now just in such a hurry, any friends here knows about them please help we out, we need your helps, I really wish I can be in the U.S. on that day my husband comes back home from overseas after a year...

Your husband cannot attend the actual interview in Guangzhou anyway. At best he could wait in the coffee shop on the fourth floor while you're on the fifth.

Since you are filing K3, your husband will need to send you an I-134 with supporting documentation but he does that closer to the interview. If you need a co-sponsor then same from them. Unless you have the evidence of your ongoing relationship and communication, he should send that along too. DS-156 and other forms will be sent to you directly from the Consulate. DS-156k is not used for K3 visas anymore.

Thanks for the help so much!!! But I still need some more help: Does my husband have to attend the interview in U.S. on his side since he applies K-3 for me ?

There is no interview in the US for a K3 visa. At some point after you enter the US, you'll file to adjust status to permanent resident. There is an interview for that requiring both of you to attend. I suspect that would be sometime in the second half of 2009 at the earliest. Will he be back in the US by then?

If not, perhaps you are better off just filing the I-130 and arriving in the US with a CR1 visa. In that process there is no interview for the US Citizen and you arrive in the US with permanent resident status. You would have a green card in hand within a few weeks of arrival. This would enable you to come and go as you please as well as to join your husband at his overseas post. While residing abroad on military orders, you are considered the same as being in the US as far as the waiting time for citizenship eligibility.

A spouse on military deployment can have the CR1/ I-130 process expedited which would render the advantage of a K3 for speed, negligible.
