Hey, did you know you can go to Canada/Mexico for up to 30 days once you enter the USA with your K1, provided you remain a fiance/fiancee.

Who else was told this at their POE?

I thought it was very excessive, overly helpful information provided by my Immigration Officer!

never read that before on here,but again, I rarely trust what POE officers have to say,lol When i crossed in Maine they didnt even know how to process my CR-1 visa! lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You're right, I shouldn't be so trusting. I even asked the IO if she was sure. She said it's a loophole not a lot of people know!

Innneresting. I won't be using that loophole, but it would be something worth looking into for emergencies, I suppose. I'll google it when I have time.

Can a K-1 Visa Holder Leave the United States?

The K-1 visa allows a fiancé(e) to enter the United States one time only. If you leave the United States after entering on a K-1 visa, you may not re-enter on the same visa. If you want to leave and re-enter the United States, you should apply with Form I-131 Application for Travel Document to the USCIS office that serves the area where you live for advance parole to return to the United States. See Emergency Travel for information on how to get a travel document that allows you to return to the United States.

Haha, ok ok. I see this is not a new thing!

Nice one, guys! I wonder what else they tell people at POEs.

"Do you know with your K1 and I-94 you can automatically pass Go and collect $200 at your nearest Social Security office?"

"Do you know you don't have to marry the USC named on your K1? You can marry any USC you choose!"

Alright, I should go do something productive now, like join a yoga studio.

Oh, sorry. I guess I should clarify. We were told that information by the Consulate..... not by the CBP. They also said that there was no guarantee that they would reissue it..... that there would have to be a pretty darn good reason as to why I would enter and then come back without marrying. Their advice was not to risk it.

Interesting..When I saw on my I-94 that it was stamped **multiple entries** I called the buffalo border crossing..I talked to a guy there(who consulted my question with the other officers there) and told me that as long as we hadn't married yet I could cross back and forth(on the I-94)..but as soon as I was married I was considered **out of status** on my I-94 .... he said they do this to allow people to finish their moving and what not..now..he also said..that one needs to be very careful because not all border crossing officers know all the ins and outs and legalities..lol I did not cross (I was more enquiring because my daughter wanted to go see her Dad).. not worth the risk..but apparently it can be done.

I'd say the person who stamped your passport as multiple entry did so by mistake. K1 has always been single entry visa, and requires AP in order to be let back in the US.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

it wasn't my visa that was stamped mulitiple entry..it says it on my I-94(everyones does I think) and he was referring to being able to cross the border with the I-94..like I said I dunno I never tried it..BUT I called again yesterday(out of curiosity) and was told the same thing..**shrugs** lol I hope they're right..because eventually if they tell that to people..someone is bound to believe them!

Same thing here my I-94 said multiple at the Rainbow Bridge in Niagara.

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.
