I’m reposting my message. Can someone help and tell me if I will be deported?

HI everyone….

I need some advice. Here is my situation. I’m originally from Russia (I’m/was an orphan; don’t have anything back at home). About 4 years ago I was working for American Christian organization in Russian, felt in love with an American girl, we got K1 visa, got married, got the house, got two cars etc. About 9 moths ago I discovered what my wife is cheating on me. I do have enough proof to prove what she committed adultery. (Phone records, statements of the friends etc).

We applied for removing my condition about 2 moths ago.(i-751) We filed jointly because at that point we were going to consoling and we were (I was) thinking what we will work it out. My paperwork got accepted by Vermont in 3 days, and 23 days after that I received fingerprints appointment. I did my fingerprints appointment. It this point, I’m just waiting either on the appointment or my green card.

Couple of days ago, couple of my friends told me what she decided not to wait for my paperwork to arrive and she s going to leave. I talked to her about it and she told me what I got 3 weeks to refinance the house and my car and after that she doesn’t care. She also stated what she will write any statement I want for INS, but she is not going to come to the appointment. (Because she is moving in with her new “boyfriend” in another state).

I have load of paperwork stating what marriage was entered in a good faith, what she cheated.

So what is going to happen to me? Am I going to be deported? I don’t have anything back at home and I have home, car and a great job here. What should I do? I have no idea……. Please help….

Hey relax.

Nobody is going to deport you because your marriage was legit.

Organize your things and move on.

March 2003...AOS Approved

May 2003... Flew to SA. Reapplied for F1. RFE and Finally Approved. 2 year F1 visa in Passport.

Jan 21 2004... Married in Chicago

Aug 2004... Applied for AOS, Petition for spouse and EAD

Feb 2005... Joshua, our little cutie pie is born on SuperBowl Sunday

May 2005... EAD Approved

Dec 17 2005... AOS & Petition approved (2 year green-card received)

Aug 4 2007... Mailed in I-751 = $275 (remove conditions)

Aug 31 2007... Everything returned, filed too early, wrong fee

Sept 17 2007 Refiled to NSC

Sept 18 2007... Delivered by DHL to NSC

Oct 10 2007... Received at CSC

Oct 15 2007... Check cashed, transfered to CSC

Oct 15 2007... Received 1st notice with application number and 1 year extension. Notice Dated 9/19/07

Nov 1 2007... tried walk-in biometrics, refused

Nov 8 2007...Biometrics completed. Staff at Naperville ASC were great!

Nov 9 2007... Last touch

March 7 2008... Card production ordered!!!!!!!! 5 months, 2 weeks and 5 days

March 12 2008... Case Status: Approval notice sent

March 15 2008...Green card received in mail...so done with USCIS done for a few years!!!!!! :)

So do you all think everything will be okay? What if they do background check and find out what she is in another state? I’m I being paranoid? I think I worry to much.

She could be in another continent. This doesn’t make your marriage less legit.

You are paranoid, stressed, upset, angry, disappointed, etc. which is normal after such a traumatic event, but your immigration process looks OK.

You may want to contact an attorney.

like for example my case, I submitted the application as divorced. And I got it approved.

but if you leave it as it is, you might get approved as well.

The problem is that if they do call you for an appointment and she does not show up, or even if they do not request an interview, in the future when you apply for citizenship it might come back to haunt you.

Not to scare you, like I said, my case was approved as divorced. But I applied as such, I didn't apply as married when in reality I was divorced.

what I am suggesting is that you call an attorney, you have a car, a good job, and a home, I would say it's better to do things with legal advice, since you can probably afford it. There is too much at risk.
