Speed is only one consideration in deciding which immigration path to take...

K-1 is typically faster because you can file today versus having to wait until after a wedding... So just the logistics of a K-1 are inherently faster....

K1 takes approximately 6 mos.

while K3 is 1 year

I don't think K-3's are taking a year. Last I checked, K-3 was only slightly slower than K-1. The time you lose, however, is actually not being able to file until you are married. Whereas with K-1 you can file immediately if you have met your fiance(e) within 2 years.

other considerations could be how complicated the process is. K1 can and probably should be done by the petitioner without an attorney (unless maybe you have a complicated past). Not too s ure about K3 process.

Also, cost might be a factor.

01-06-08 Got engaged!!!

More to consider than just the speed in the beginning, look at the steps of after also and are you to the point of being ready to be married now or you rather wait a while

i am still confuse which is faster and better...K1 or K3. Is it better to get married outside the US then petition her or take her as a fiance.

I don't think you have to marry outside the US. It's just that your spouse would have to leave the country for the K3 process. Someone correct me if I'm wrong.

The spouse can remain in the country on any legitimate visa. At some point, however, the spouse must leave the country for the consulate interview and also because the K-3 is an entry visa.

If you can do DCF that is the fastest of them all. If you can't, then go with the K1.

We went the K-1 route, and a friend went the K-3 route. It took them 3 month longer. But...with the K-1 I am having to fill out more paper now. With the K-3 most of the paperwork is done before. (Thailand 2007).

It up to you. Do you want to wait in her country with ther, or have her in the states 3 month faster.

AOS Timeline

11/29/07 - Fedex'd to Lockbox (Chicago)

12/3/07 - Delivery confirmation..........

12/21/07 - Checks cashed!!!

01/10/08 Paper NOA1 for daughter received - Postmarked 12/20/07

MSC# on back of check doesn't match MSC# on NOA.

01/31/08 Still no news for wife. All three numbers still come up red on-line.

02/26/08 Called USCIS 800 number. Very friendly and helpful individual and supervisor.

Found out correct MSC numbers. Also found out that we missed the Bio!

We never received any appointment letter. (Originally set for January)

Went to local support office and asked about re-scheduling the Bio. Very nice manager at the office

did our Bio then and there, without having to wait since they were not busy.

April 8 and still waiting.......

May 11....and waiting, and waiting...not even a touch.

May 24 received NOA2 appointment for Interview for 30 July. Web page still not updated.

July 30 - Interview. APPROVED. Green card will be sent.

9/12/08 Called USCIS asking where GC's are?

10/15/08 Get letter from USCIS that GC's were sent August 8. Never received them.

10/20/08 Sent forms and $740 for two new GC's.

11/7/08 Received confirmation of receipt for new GC's.

11/12/08 Received BIO appointment.

11/25/08 Bio done.

Waiting, waiting, waiting

January 2009 finally received GC!

May 3 2010 Filed for Removal of Conditions.

June 21 Bio appointment.

August 11 Approval letter. No Interview.

August 21 - 10 Year card received.

K3 does all the same paperwork after arrival except for advanced parole. CR1 is the visa that skips the immediate after entry filings.

Please understand that cases in the same category and same country can have timelines that vary more than three months. The time gained with K1 is primarily that one can file earlier because they file before marriage.
