Timeline

I am assuming this part of the process wont be a challenge at all for us. but as iam preparing the information for this I-134 do i really need past 3 years of tax returns?

I have 2006 and 2007,but in 2005 i didn't have any taxes and i didnt file at all, i have heard if you include tax records you need 3 years.. i am sure there is a workaround in this circumstance? I will also provide my fiance with a letterhead from my employer and pay stubs for this year. so just give me any insight on what i should do and how i should approach this.

I don't think it has to be exactly three years because i only sent my 2005 and 2006 tax transcript to my fiancee and she got approved. you see you are sending those documents to prove that you have a continuous income so two years should be fine but it may be different from one consulate to another. and also they are mostly interested in your current income so if your current income is above the poverty line you should be ok. Just make sure you provide them with a letter from your work, 3 of your most recent paystubs, your tax transcripts in your case two of them. i hope this helps goodluck.

Three years is best practice. You can't provide what doesn't exist. Be sure your fiance(e) can answer any question about 2005 if asked.

Timeline

Just file your 2005 taxes - showing zero income if that's the case. You may actually have income and be below the taxable threshold, so do fill it out based on your W-2. Then you can use the copy of it for your submittal. Even if you do not have to file taxes - you still can file taxes and use the documentation for purposes 'other' than taxes. Good Luck
