I filed a NR-73 back in 2002 and was deemed a factual resident of Canada and continued to file my CDN tax returns as a resident since 2002. However, I've severed all ties with Canada except for two secondary ties, bank account and passport. I am getting ready to file my 2007 CDN tax return and was going to enter departure date of Jan 1, 2007. But because I was deemed a resident back in 2002 because of the NR-73, will this pose a problem? Anybody with a similar situation? Thanks.

I would file a new CR-73 and have them make a new determination based on your present circumstances. You are obligated to continue to file as a resident until such time as CRA makes a determination that you are no longer a deemed resident of Canada. I would call the International Tax Services Office to confirm this.

I called the International Tax Department in Ottawa today. They stated since I did complete one back in 2002 and now that my circumstances have changed I will need to fill a new one out for them to make a determination. I asked them if I will be required to provide further documentation. The guy said probably not.

I heard that if I am finally determined a non-resident, they may ask for proof. (such as tax returns, etc)

Does anyone know if they will accept IRS for 6166? (Foreign tax Certification) Proof that I was indeed a US resident for a particular tax year.
