Hi all,

Thanks for everyones help so far on this journey, I need a little more advice though if anyone can help.

First off, my fiancee, Nikki, submitted our I-129F at the end of Jan, we received our NOA1 on Feb 5th and it was touched on 24th Feb. Since then we have heard nothing and to be honest, I have been so busy at work and she's been swamped studying for her MCAT, so apart from the odd check to see if our status has changed, I have not been putting a massive deal of though into our visa.

I've been doing a little research into what I need to do next though and whilst looking through the K1 Visa timelines for people in the same situation (Vermont Service Center, Fiance is a UK resident) I have noticed that the vast majority seem to have received their NOA2's within 25-50 days. It has been over 2 months since we submitted and have heard nothing, would there be a reason for this? I see a lot of people who submitted after us have already received their NOA2's, some already have interview dates set, and I am concerned as to why ours might be held up. Secondly, as my fiancee is a struggling student, she will not be able to be my affidavit. I understand that you can get a co-sponsor if your fiancee does not earn above the poverty line. Originally, we planned for my fiancee's mother to be the co-sponsor, however, my fiancee has recently had a falling out with her mother, as she found out that her mother had been stealing the inheritance left to her by her father. We no longer want to use her as a co-sponsor, however, my Uncle lives quite close to my fiancee, would it be possible to use him as a co-sponsor or would that cause problems as he is my family member?

The co-sponsor can be any person who is permanent resident or citizen of the USA. It doesn't matter if you have a family member as a co-sponsor. Mine was my sister's husband and I was the imigrant. Also, I recommend that your fiance will attach an explanation letter about why she didn't work last years or now, she can attach evidence like schools records. This ssuggestion is only "if they will ask for". Good luck.

Feel blessed you can get a co-signer. I am as well a struggling student but have to come up with the means by myself.

You will be fine, it doesn't matter who the Co-signer is. It could be the President of the United States for crying out loud.

Hey although some people get the NOA2 in 25-50 days, others don't. Don't worry there's nothing wrong yet.

Wait, I think people have been misreading your post about the affadavit. Is your fiance the petitioner, and SHE lives in america, and you are the beneficiary and you live in the UK? I am confused because first you said your fiance is a UK resident, then you said later that SHE cannot be YOUR sponsor alone and that you need a co-sponsor.

If you are the US citizen then NO ONE in her family/friends can be a co-sponsor unless they are in the US. If all her family lives in the UK then no one can be a co-sponsor for you guys. Only some one who is a US resident or more can be a co-sponsor, meaning that if YOU are the US citizen and the petitioner than someone in your family, or one of your friends, has to be the co-sponsor.

And it DOES matter who the co-sponsor is. Like I mentioned, it doesn't as long as they are in the US.

Thanks for the replies guys, sorry if the post was a little confusing; I am a UK resident, my fiancee is a US citizen and my Uncle is a US resident. So from what I gather, it will be fine to use him as a co-sponsor (thats if he agrees!!!!)

Just out of interest, does anyone know why some applications get processed quicker than others? I imagined the applications would be processed in accordance to when they were received, unless any further evidence is needed which would obviously slow things up. Is there any rhyme or reason to why one application can take 30 days to be precessed to the NOA2 stage and another can take 4 months? I presume that the answer is no and it is just "one of those things" but I thought it might be worth asking.

Okay so you're the UK citizen and your fiance is a US citizen. I understand now, and th information I gave you above still applies.

Hmm why do some applications get processed quicker than others? Luck? Not really sure, some people say that they just take all the petitions from one month and don't organize them according to date, while others say they do.

I know that I sent our I-129f petition to the USCIS on November 1st, got our NOA1 on the 8th I believe, then got our NOA 2 on March 10th. I was one of the first out of the November filers to get the NOA 2 and 4 months for USCIS is pretty quick compared to all the other timeframes I was reading.

I didn't have a single touch from the NOA 1 date to the NOA 2 and I thought it was kind of weird.

After you receive your NOA 2 it gets sent to NVC. It's been taking on average a month to get there, and a couple days to get sent out to the embassy and processing at NVC, etc.

Our petition was received by NVC on I think the 17th or so, then they sent it out and our embassy received it the 26th.

Also, we sent our I-129 (my fiance is an American citizen, I am British moving there) and received the NOA1 just a short while later on the 19th of November 2007. So far we haven't heard anything at all, whatsoever. Apart from assembling the relevant financial support documents, is there anything we need to be doing with the affadavit of support? My understanding was that we wait for the NOA2 then deal with the affadavit; is that correct?

Being touched does not really mean a lot. I would not depend on any touches as they have really little meaning.

Yes you are correct Jack, wait for the NOA 2 and then start collecting most of your financial information because it is bound to have changed during the waiting time for approval.
