Once we get married we then file for an Adjustment of Status.

How long does the AOS take to be issued/ the SSN issued?

Hypothetically, If we got married on the 40th day after my fiancee's entry into the USA and then we file for the AOS on the 45th day, would her SSN be issued before the 90 days are up?

We are a little confused, obviously the AOS needs to be filied before the 90 days are up, however can my fiancee still be in the county after the 90 days are up if her SSN has not been issued?

If the 90 days were up and she still hadnt recieved her SSN (however the AOS had been lodged) would she need to file sme kind of 'bridging' visa or pay a fee to keep her in the coutry until her SSN is recieved?

Cheers!

On a K1 as long as you marry within the 90 days as far as i understand you can stay legally and no further visa is necessary while you wait for the aos.

A "visa" is used to enter a country. K1 holders, once married, need to adjust status to permanent resident at minimum. Most seek EAD and Advanced Parole along with AOS because they are included in the same fee.

Steve,

You are asking numerous questions, the answers to which are found in the guides and form instructions. I advise you in the strongest of terms to read the guides and study the form instructions in order to learn the process. Then ask your AOS questions in the AOS forum.

Yes, we know that a Visa is used to enter the country and too that once married we need to file for an AOS,that was not our question. If you read our first topic you will see that we were inquiring as to whether the the AOS needed to be filed within the 90 days.

Furthermore, the AOS question was not meant to offend you here in the K1 Forum, more so it was just a mistake.

A responder said no further visa is needed. The first sentence of my post is in response to that.

I am not offended by your posts. I'm advising you on the best way for you to have success in the process.

I'll try to answer your questions as simple as I can...

If you plan of getting married on a civil or may be in church try to inquire first if they need an SSN# of your fiancee or they would just take her passport as a valid id, or otherwise, you can just wait till you get married before applying for her SSN( anyway this is not a requirement for AOS). Furthermore, it usually takes a month of process to get an SSN. For as long as you will be married within the 90 days from the day that she stepped on the US...then she is legal to stay. Then after the wedding/honeymoon you can start your AOS so she could enjoy the benefits of being a GC holder like; she could get a driver's license/state id/get a permanent job...

By the way, if your fiancee is lucky enough, she could have her GC 4-6 months from the day the process has began. If not, some people even have waited for a year...it all depends of which service center your papers are.

P.S. I couldn't find the previous post here that tackles about the pros & cons of applying SSN before/after getting married. Some says its a lesser hassle to get one before...but either ways its all up to you.

Hi Steve,

The AOS processing time varies widely - from a couple months to more than a year. The Conventional Wisdon here is that Your NOTICE OF FILING THE AOS is sufficient for documenting your legal status in the country for that interim time between when the I94 expires (90 days after entry) until the AOS is conpleted (or at least the EAD is issued).(assuming , of course that you did in fact get married within the 90 days of arrival). There is no other application or action or fee necssary (what you are referring to in your post as "some kind of 'bridging' visa or paying a fee").

The SSN issuance process is not tied to the AOS process. There is no need to wait for AOS to apply and receive SSN.

Pushbrk gave you some good advise. The framing of your questions appears that you may have some misunderstanding of the defination and approach to the various processes in the stage you are in (don't we all!!! :) ) Reading the Guides can help immensly, not just for answers but also for framing additional questions to post to VJ.

Best Wishes to you!

Warm Regards,

Samby
