We have heard a few rumours that once the K1 is approved and the foreign fiancee enters America that it is best to wait a month or more before getting married. We were told this from a LA immigration lawyer as he said that Immigration may view a marriage promptly after arrival as not legitimate.

Any views, comments, suggestions about this?

At first when we were told this it seemed understandable, but now the more we think about it the sillier it seems, as it appears that the K1 petition (I-129F) is where all the legitimacy is proved.

The visa interview is the first place bona fides of the relationship are evaluated. The second time is the AOS interview. You only have 90 days in which to marry after US entry, so whether it's day 5 or day 90 makes no difference.

If I had it to do all over again. I would file for the K-1 visa. Get married immediately after then just turn in the marriage documents (or marry again here) after your husband/wife enters the US. Your wife would have to delay changing her maiden name, or just take no action in the case that you have a husband.

If this is possible it would allow you to be married wilst enjoying the benefits of the speedy K-1 Visa.

The immigration officer doesn't know what he's talking about. He is talking about entering on a different visa. They already assume with a K1 that you're intending to immigrate. What a goofball! :bonk:

Thanks for the info! Yes, the more we thought about the information the sillier it seemed. Not a good thought to be know that there are lawyers out there passing on incorrect information.

My friend's fiancee arrived from Hong Kong on a K1, and they married the very next day! It makes no difference if you marry on day 1 or day 90...just do your best to make sure you are married anytime within those 90 days. Check with your state to see what is required (paperwork) in order to be married. In Ohio, if you're 'of age' there are no requirements...just show up and say 'I do!' :thumbs:

I would suggest marrying within, say, 45 days or so for one or two reasons.

1) If memory serves, the time for filing for the SSN & card runs out 2 weeks before the 90 day limit. If so, marrying earlier in the 90-day window lets you get that ball rolling sooner and avoid "cutting it close".

2) The advice given by that person about marrying early is more uninformed suggestion or possible opinion than anything else, at least thats I how I feel. As I stated in #1 and here, while there is no rush to do it, I think that getting hitched lets you start the next step that much sooner, Adjustment of Status and furthermore, its getting married! Why would you want to wait for such a happy event :)

Others wait a little longer because they wanted to make sure that the relationship will really work. :whistle: We got married 21 days after my arrival here in US and everything went well with all my immigration paperwork. :thumbs:

I entered on October 28th, got married on November 1st, so we waited 3 days to get married. My husband was on military leave for about a week and expected back in his unit in NC asap (we got married in TX). Also, I already had a SS Card so we didn't have to worry about that.

Removal of Conditions Timeline:

03/19/2008 - package sent to TSC, let's hope for the best

03/20/2008 - check cashed

03/26/2008 - case sent to Vermont Service Center

04/17/2008 - Biometrics scheduled

05/19/2008 - received I551 extension stamp via INFOPASS

02/12/2009 - APPROVED

02/21/2009 - GC received...no mistakes...valid until 2019

We got married exactly two weeks after he entered the US.

We passed AOS without an interview. We apply for LOC in August of this year.

It's all good.
