Helloo everybody,

My I 130 was transfered to local office. And after four months they sent me RFE letter. So i was hoping if you guys could help me out with this. I would really really appreciate your help.

BCIS wanted to see these things.

1)

Request for exemption: according to some law if somebody got married after 1986 and is under removal proceedings they have to submit it.

Q:but this thing is that we got married when i was still in status. So should i still write the request or tell them that i was married way before i was put into removal proceedings.

2)

Lease: We have been living at the same place for almost three years. and i got a letter from manager too.

So hopefully that will suffice.

3)

statements from friends and families: They did not say from whom or how many or if they should be notrized. So should i just tell my family and friends to notrize them anyways. and how many should i get.

And if anybody can please tell me what kind of stuff should be written in it(format). Or should they just write it in general.

4)

Birth certificates: we did send them birthcertificates with the petition, so i guess we will send them again. But with petition, i had a copy of my birth certificate in english attested from my native country. So should i get one again from my native country or is there any way that i can get the original one (i have that with me) translated in US.

5)

Statments from us: BCIS also wanted us to write about how we met? Should we write seperate ones or just write one and we both can use the same.

6)

Removal Proceedings:

They also wanted me to tell them about removal proceedings. So should i just make a copy of everything that we have and send it to them.?

And is it a good thing to have RFE when its transfered to local office or bad?

Please help me out with this. Caz my lawyer is not. I will truely appreciate any help

You're in removal proceedings.. you're in attorney land... Call an attorney to help you with this now...

If you're attorney is not helping you with this, then it's time to call another attorney.

I always thought that an RFE was better than just sitting on somebodies desk. I think you have posted this in the wrong forum though. You should have put it in the K3 or AOS forum. You will get more " in country " experience.

If your spouse was here I thought the procedure was to file I 130, wait for the NOA and file the I 485 to adjust status, along with the EAD. It sounds like the AP will be a waste of money. Since they wont be allowed back in the country if they leave regardless of the AP.

Take your question to the AOS forum. You will get more answers there. You should provide much more information so that you will get good advice.

11 May 05 sent petition to Bogota

18 May Packet 3 arrived

19 May Checklist taken to consulate

31 May Packet 4 delivered

29 June visa granted

1 July Visa delivered

Sometime in July Lucero came to US

13 Sept 05 Married

1 Nov 05 -USCIS recieved 485 and EAD

13 December RFE stupid things I should have included Returned very quickly

27 March received bio letter for New Orleans

7 Apr_06 Bio done in New Orleans

20 April 06 Touched on all applications

21 April Email received EAD approved

27 Apr Received EAD card

30 May 2006 Received appointment letter for JaX on 13 July 2006

13 July Interview successful approved

20 July Received green card

30 June 08 Sent I751 to remove conditions

25 July 08 Application returned erroneously incorrect fee

27 July mailed new application with separate checks

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.
