what exactly are they looking at for NOA2?

So, that title probably didn't make any sense, so here's my question...

What exactly is the USCIS "investigating" when they're reviewing the I-129F petition to decide whether or not to approve it...are they investigating the petitioner or the beneficiary, or simply looking for red flags about the relationship, proof of meeting, etc....?

The reason I ask (and I posted about this before but still am not sure how to proceed so I'm asking again in a different way, sorry if this is repetitive) is because my fiance (Australian) was born with his bio father's surname, but his mother remarried when he was 11 and she changed his surname to his stepfather's. He has never used his birth name legally, so we overlooked the "other names used" section on the G325 or whatever the heck they're called... :dead: anyway...so now I have the dilemma of whether to try to amend it now, or to wait until the petition goes to the Consulate in Sydney. I figure we can probably wait since it was an oversight, and after all he was only 11, but I'm wondering what they're doing at this stage of the game because I don't want them to say, later at the interview, "guess what sucka, prior to issuing the NOA2 we ran this and that name check on him, and now we have to re-do the whole process." You know what I mean? I would rather wait because my fiance is here now and doesn't have access to all the name change records which are back in Sydney, so if I tried to amend it now, I wouldn't have the documentation to back it up and I'm afraid it would create a big cluster-you-know-what. So, if it's a huge deal we can try to figure something out, but I'd like some opinions about whether it would be ok to wait and have him provide that documentation later, at his interview? :wacko:

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.

thanks! so you added the info when you sent the I-129F, yeah? i failed to do that (and don't have the documentation right now to send, either), so i don't know whether it would be ok to just deal with it at the interview...?? thoughts, anyone... *sigh* maybe this sounds like a simple problem, but it's really stressing me out...

On this status, I-130 is mostly checks of the petitionner where the beneficiary, beyound the G-325 form that is asked with it, it's not asked any documents (but I still sent a copy of passport as proof of identity on my part); I forgot to sign of the 4 sheets, and worried all the months that i'll receive an rfe or not about it, and thinking of sending another sheet but i was adviced by one of the specialist in paperwork here at that time not to send another or additional info because they it can be lost in the huge amount of papers they receive; I didn't and didn't get any rfe...

Then at NVC level, with the Ds-230 form called the immigrant application form (the beneficiary's) they ask original documents or certified copies. This step is when they do more background checks of the beneficiary (from the original documents we sent). I believe (and if i'm wrong someone correct me) that the 1st step is to check on the petitionner.

Now, where is the documentation as proof ? can you get at least a certified copy?

Maybe you can make corrections with the next step, writing a nice additional paragraph completing the info you wanted. And oh we also did a cover sheet enumarating all the documents, in the order they ask on the instructions. All in all to make the paperwork more easy for them to reach.

You can do a fresh I129 and add the 'missed' info and then tell them at the interview what happened and give them the corrected form - many people have done this to correct errors in names/dates etc. I would assume that there should be no real issues - since your fiancee is also submitting or will be submitting police reports. Good Luck

I don't have the I-129 form in front of me as well as it's instructions; we followed the Cr-1 path, with the I-130, the petitionner's form to beggin with, it's then we completed with an additional sheet. On this status, I-130 is mostly checks of the petitionner where the beneficiary, beyound the G-325 form that is asked with it, it's not asked any documents (but I still sent a copy of passport as proof of identity on my part); I forgot to sign of the 4 sheets, and worried all the months that i'll receive an rfe or not about it, and thinking of sending another sheet but i was adviced by one of the specialist in paperwork here at that time not to send another or additional info because they it can be lost in the huge amount of papers they receive; I didn't and didn't get any rfe...

that does help a lot. as for the documention of his name change, it's packed away in sydney, so we DO have copies of it all, but we won't have access to it until may when my fiance returns to australia. so i didn't know if it would be best to send it to USCIS in may (possibly delaying the process or getting lost), or just waiting until the case went to the NVC to deal with it then. from your post, i imagine it would be fine to deal with it at the NVC level, and when he sends in his checklist and prepares for the interview, we can just maybe send copies of everything along with a paragraph explaining it, like you said. that would probably be best. thanks so much for your reply!

My pleasure! But careful, reading to redo a "fresh" form...I would not do it (they might ask then which is which...bureaucracy is bureaucracy and they are very picky)...in lieu, I would attach a copy of the page you made an error underlined in red or yellow, with another sheet where you explain: "Correction, Question no x, form I-129, I omitted to precise my adoption name; i can precise i never used it legally because i was adopted at x age and used exclusively x name".

On the cover sheet i will add this info like: Correction q. x, for omitted name at adoption.

All in all is to be consistent without redundant papers....because they can send it back stating they don't get it or an rfe who knows...name paperwork is important for the background cheks and for the police certificate for later procedures...

As for the NVC, i don't know for the K-1, pls see the instructions...but on my IV status, at NVC it was the only phase where they ask the beneficiary original documents and not copies...I wonder if you'll have not to produce originals only in the AOS step, after the interview and once you are in the US.

USCIS makes sure all the requirements are met for filing with all the documents, signatures etc etc. Then they investigate the petitioner.

When the petition gets to NVC, the beneficiary is investigated.

Then when the petition gets to the embassy, the relationship is scrutinized to make sure its real.

wait, i think i've been confusing the NVC with the embassy. they investigate him at the NVC before it goes over to sydney?? i thought if we dealt with it at the embassy maybe it would be ok at that stage...then again, shouldn't it be? i can't imagine them wanting to investigate him under a name he hasn't used since he was 11...
