Thanks for your replies though smart ####### comments not so much appreciated .. most people I know see the situation like I do.. guess it look different when you are used to dealing with immigration/ law. But from a lay persons view point I am not being stupid nor trying to be difficult. At least I know this is an issue to check out now though and can ask about it in my interview.

I was not ignoring you aussie and will bear the JFK option in mind (thanks for the reminder) but I really need to know before then so will ask about it at my interview if not before. I am afterall expected to give a months notice at work.

Another thought comes to mind - the income tax implications of what you propose. You might want to look into that aspect of it if you haven't already.

It is an issue - as you say, you will be working in the USA. Who you are working for does not change anything - there are a lot of foreign employers here in the USA.

As Aussiewench recommended to you in your other thread, read 9 FAM 40.41 Notes, in particular N4.6-2.f(1) (I think that paragraph may apply to your circumstances).

NO, no, no... I am not going to be employed in the USA... I will be employed in the UK, just working from home (which happens to be in the USA)..... I did not think this was going to be an issue...

You didn't state that about your job before, globetrotter. We were replying about your fiance's contract job ending and what issues that may present you.

If you will still be employed when you get to the States, that may be taken into consideration. You'd probably have to get temporary EAD - via JFK airport - (and then apply for EAD right away) in order to do that, though.

And I'm not sure how that would be documented for them to see in London, but I'm sure someone here has done that before.
